Vývoj trestního práva v 18. století v našich zemích Resumé Ve své práci se zabývám vývojem trestního práva v 18. století v našich zemích. V 18. století došlo v důsledku osvícenské filozofie a beccariánské trestněprávní reformy k významným proměnám trestního práva. Práce se skládá z úvodu, závěru a šesti kapitol. V úvodu je vysvětlena terminologie užívaná v práci a teoretická a filozofická východiska, ze kterých při výkladu vycházím, např.: osvícenství, trestní právo, vliv osvícenství na proměnu společnosti 18. století. Kapitola první podává stručný výklad vývoje trestního práva do 18. století. Kapitola druhá se skládá ze čtyř podkapitol a na rozboru tehdy platných zákoníků ilustruje vývoj trestního práva v první polovině 18. století. Část první se zabývá kodifikací městského práva z roku 1579, jejímž autorem byl Pavel Kristian z Koldína. Část druhá obsahuje stručný popis trestněprávní kodifikace práva šlechtického - Obnovené zřízení zemské z roku 1627. Část třetí pojednává o prvním pokusu o sjednocení trestních norem, převážně však procesní povahy, Constitutio Criminalis Josephina z roku 1707. Část čtvrtá obsahuje rozbor kodexu Marie Terezie z roku 1768, který byl vyvrcholením feudálního pojetí trestního práva. Kapitola třetí se soustředí na vývoj trestního práva ve druhé polovině 18. století, po vydání... Development of criminal law in the Czech lands in the 18th century Resume My thesis deals with the criminal law of the 18th century in our country. The 18 century Enlightenment philosophy and criminal law beccarian revision created significant changes in criminal law. The thesis has six chapters plus an introduction and conclusion. The introduction explains the terminology used and the theoretical and philosophical bases of what the interpretation is based on, for example: the Enlightenment, criminal law, the influence of the Enlightenment on the transformation in the 18th century. Chapter One explains the development of criminal law until the 18th century. Chapter Two is broken down into 4 sections of analysis and then illustrates the applicable codes of the criminal law in the first half of the 18th century. Part One deals with the codification of the city Rights of 1579, designed by Paul Christian of Koldin. Part Two contains a brief description of the criminal law codification of the law of the noble - Renewal of the Earth's establishment in 1627. Part Three deals with the first attempt to unify criminal provisions, but mainly the procedural nature of the Constitutio Criminalis Josephine in 1707.
