Cílem této práce je obecné pojednání o ochraně osobnosti poskytované českým právním řádem a hlubší analýza tří vybraných aspektů ochrany osobnostních práv. Práce se soustředí především na ochranu osobnosti poskytovanou na základě ustanovení zákona č. 89/2012 Sb., občanského zákoníku, a Evropské úmluvy o ochraně lidských práv. V obecné části práce je v prvních kapitolách stručně nastíněn historický vývoj osobnostních práv na našem území a definice pojmu osobnosti a osobnostních práv jako takových, společně s demonstrativním výčtem hodnot chráněných všeobecným osobnostním právem. Následující kapitola je věnovaná přehledu pramenů osobnostních práv na ústavní, zákonné a mezinárodní úrovni. Další kapitola se zabývá oprávněnými a neoprávněnými zásahy do osobnostních práv člověka, podrobněji je pojednáno o informovaném souhlasu se zásahem do tělesné integrity člověka. Závěrečná kapitola obecné části práce podává přehled prostředků ochrany osobnosti, jimiž se dotčená osoba může domáhat nároků z neoprávněných zásahů do své osobnosti na české i mezinárodní úrovni. Zvláštní část práce se soustředí na detailnější analýzu vybraných aspektů osobnostního práva. V šesté kapitole jsou na základě četných příkladů z judikatury představeny hodnoty chráněné širokým pojetím práva na soukromí tak, jak jej chápe český... The objective of this thesis is to provide an overview of general part of the protection of personality in the Czech legal system, as well as a detailed analysis of selected aspects of personal rights. The thesis focuses on protection provided by the Act Nr. 89/2012 Sb., Civil Code, and the European Convention on Human Rights. Initial chapters of the general part of the thesis deal with brief introduction to the historical background of personality rights in the Czech legal environment, as well as with the definition of personality and personality rights as such, together with a demonstrative list of values protected by the general right of personality. The subsequent chapter provides an overview of Czech and international sources of law concerning personality protection. Chapter four deals with lawful and unlawful interferences with personality rights. The final chapter of the general part outlines legal means of protection of personal rights available according to the Czech law. The special part of the thesis is dedicated to a deeper analysis of three aspects of protection of personal rights. Chapter six deals with one of the most important personal rights, the right to privacy. This chapter aims to introduce the broad concept of privacy, including case law of the European Court of Human Rights...
