RESUMÉ Vydržení Tato diplomová práce se zabývá institutem vydržení. Jejím cílem je popsat podobu tohoto institutu v českém právu a zasadit jej do širšího rámce. Vydržení je způsobem originárního nabytí vlastnického práva k věci. Institut vydržení řeší situaci, kdy držitel není vlastníkem držené věci. Pokud je držitel v dobré víře a drží způsobilou věc z řádného důvodu, získá po určité době k této věci vlastnické právo. Text práce je rozdělen do pěti kapitol. Na začátek práce je zařazen úvod, který shrnuje cíle práce a vysvětluje důvody zvoleného konceptu a struktury práce. První kapitola se zabývá otázkami, které s institutem vydržení souvisí. Je zde popsáno, co se v českém právu rozumí věcí a jaký je význam věcných práv. Dále je pojednáno o tom, v čem spočívá držba, jaký je význam držby, jak je držba chráněna. Dále je v této kapitole vysvětleno, co je vlastnické právo a jak se dělí způsoby jeho nabývání. Tuto kapitolu uzavírá krátké vysvětlení, co je vydržení a jaký je jeho význam. Druhá část se zabývá tím, jak se institut vydržení měnil v průběhu historického vývoje. Je stručně popsáno, jak vypadal institut vydržení v římském právu, v obecném zákoníku občanském z roku 1811 a v občanském zákoníku z roku 1950. Acquisitive prescription This Master's degree thesis deals with the topic of acquiring the right of ownership by prescription (usucaption). Its aim is to describe the form of the institute in Czech law and to put it into a broader framework. Acquisitive prescription is a means of original acquisition of ownership rights to things. It solves the problem, when possessor does not own the object of the possession. The ownership to the thing is acquired under these conditions: good faith of the possessor, just title, possession for required time. The thesis is composed to five chapters. The introduction summarizes the aims of the study and explains the concept and the structure of the thesis. Chapter One is introductory and defines basic terminology used in the thesis. It describes the concept of things and rights in rem in Czech private law. Then it explains the theory of possession, such as its fundamentals, its meaning and protection provided to the possessor. After that it focuses on definition of ownership and methods of acquiring the right of ownership. This chapter concludes with a short explanation of what is acquisitive prescription and what is its significance. Chapter two focuses on the history of this institute.
