Předložená diplomová práce pojednává o přestupcích proti bezpečnosti a plynulosti provozu na pozemních komunikacích. Toto téma je velmi aktuální, protože s těmito přestupky se za svůj život setká každý z nás. Tyto přestupky jsou upraveny v zákoně o silničním provozu. Obecnou úpravu obsahuje zákon o přestupcích. Práce je rozčleněna do sedmi kapitol. První kapitola seznamuje s historií úpravy od vzniku samostatné Československé republiky v roce 1918 do současnosti. Následuje kapitola popisující účinnou právní úpravu. Tato kapitola obsahuje obecnou úpravu odpovědnosti za přestupky, dále pojednává o znacích skutkových podstat přestupků a je zakončena charakteristikou skutkových podstat definovaných zákonem o silničním provozu. Ve třetí kapitole jsem se zaměřila na porovnání přestupků a trestných činů. Opět jsem nejdříve srovnala obecnou úpravu odpovědnosti za přestupky a za trestné činy. Dále jsem vyjmenovala, které trestné činy by mohly být spáchány v souvislosti s provozem na pozemních komunikacích, a následně jsem se zabývala dle mého názoru nejčastěji páchanými trestnými činy. Čtvrtá kapitola se zabývá sankcemi, které je možné za přestupky uložit. Pravidla pro ukládání sankcí jsou stanovena zákonem o přestupcích; konkrétní výše sankcí jsou stanoveny zákonem o silničním provozu. S přestupky proti bezpečnosti... The presented thesis refers to the administrative transgressions against the safety and smooth traffic flow on highways. This is very actual topic currently, because everybody meets with these administrative transgressions in his life. The thesis is composed of seven chapters. The first chapter introduce us with the history of legislation in the period from the formation of the Czechoslovak republic in 1918 to the presence. The following chapter describes relevant legislation. This chapter contains general regulation of liability for transgressions, as well as discusses the constituent elements of transgressions and ends with characteristic of the constituent elements defined by the Law of highway traffic. In the third chapter, I focused on the comparison of transgressions and crimes. First I compared the general arrangement for liability for crimes and transgressions. Furthermore, I have listed which crimes could be committed in connection with the highway traffic, and then I looked on, in my opinion, mostly committed crimes. The fourth chapter deals with the sanctions that may be imposed for transgressions. The rules on penalties are prescribed by Law of transgressions; the specific amount of sanctions is set by the Law of highway traffic.
