Závěr Téma sousedských práv je v právní praxi i teorii velmi často diskutovaným problémem a díky jeho úzkému vymezení v občanském zákoníku a neměnné úpravě po mnoho let nezbývají žádné aspekty, které by snad již nebyly řešeny. V mnoha zdrojích včetně soudní judikatury bylo publikováno velmi mnoho odborných názorů, které se sice v některých případech rozcházejí, ale v zásadě nenalézám možnost přijít se zcela novým, teorií ani praxí zatím nedotčeným návrhem řešení problémů dotýkajícím se této oblasti. Snažila jsem se proto o podání celistvého náhledu na celou oblast sousedských práv, s uvedením soudní judikatury, příkladů z praxe a v neposlední řadě i svým osobním pohledem a názorem tam, kde to bylo možné. Těžištěm této diplomové práce je úprava sousedských práv tak, jak ji zakotvuje současně platný občanský zákoník v §127 včetně legislativních, aplikačních i interpretačních aspektů. Dále jsem se snažila postihnout i možnosti právní ochrany při narušení sousedských vztahů, s důrazem na ochranu ze strany orgánů správních a soudních. Co se týče vývoje sousedských práv de lege ferenda v návrhu nového občanského zákoníku, nezbývá než konstatovat, že teprve praxe prokáže, zda půjde o krok dopředu či nikoli. Doufám, že se mi podařilo popsat a kvalitním způsobem zhodnotit materii sousedských...Sousedská práva 80 Resumé Legal relations between neighbours and their protection The legal relations between neighbours and outgoing rights and obligations, are the important part of human relations, which are existing between men from the beginning of evolution of the human society, as well as legal relations between neighbours are the relevant part of the legal orders of each individual state. In the Czech Republic nowadays, the legal relations between neighbours are stated in the act No. 40/1964 Coll., the Civil Code and it has the unfungible place in our legal order. The legal relations between neighbours belong into the area of the jura in re and they are connected with the problems of the property right. They represent one of the areas of the legal restrictions of propriety, which are necessary to respect in the interest of the same rights of the neighbouring proprietor. If the proprietor wants to exercise his powers, he has to suffer some of the restrictions of his powers, for the benefit of the same powers of the neighbouring proprietor, in the legal frame. The property right represents one of the most basic rights in the full scope of the legal systems, which is declared by the rules with the supreme legal force.
