Název diplomové práce: Aspekty registrace plavidel v mezinárodním právu (oblast mezinárodního práva mořského a registrace námořních plavidel) (Aspects of the registration of vessels in the International Law) Abstrakt: Spolu s rybolovem je plavba jedním z nejstarších a nejdůležitějších využití moře. Lodě jsou nejdůležitějším prostředkem pro přepravu zboží: 95 % celkové hmotnosti zboží přepravovaného v mezinárodním obchodu po moři. Moře a plavidla jsou neméně důležité pro vojenské účely coby bitevní pole. Zatímco téměř všechny pobřežní státy a některé vnitrozemské státy (již bez účasti České republiky) mají svá obchodní loďstva, je pozoruhodné sledovat výrazný rys této oblasti mezinárodního práva, spočívající v kumulaci plavidel pod vlajky jen relativně malého množství států. Tento stav rozhodně nezrcadlí rozdělení vlastnictví registrovaných plavidel. Hovoříme zde o "vlajce z rozumu" a toto je právě jedním z témat této práce. Tato práce se zabývá transformací od mezinárodního obyčejového práva k aktuální úpravě registrace plavidel. Udělování státní příslušnosti plavidlům je jeden z nejpodstatnějších prostředků, jak nastolit řád v oblasti moře. Národnost plavidla jednak indikuje, jaká práva a povinnosti dané plavidlo požívá, tak i jaký stát vykonává jurisdikci nad tímto plavidlem a jaká práva a povinnosti mu z... Ships are the most important means of transporting goods on such routes: ninety-five per cent, by weight, of all international trade is seaborne. On the military side is it same important battle field. While almost all costal States and some landlocked (right now without Czech Republic) ones have a merchant navy of some description, one of the remarkable features of the international shipping industry is the degree to which ships are concentrated under the flags of relatively few States. This does not necessarily indicate a similar distribution of ownership. We are talking about "flags of convenience" and it is one of the topics of this thesis. This thesis deals transformation from customary international law to current codified regulation of the registration of vessels.
