Práce rozebírá problematiku prodeje nemovitostí a to jak podle zákona č. 40/1964 Sb., tak podle zákona č. 89/2012 Sb. a srovnává oba kodexy. Nejprve se věnuje pozornost definici nemovitosti a prodeji dle zákona č.40/1964 Sb. Ale většina zájmu je věnována kodexu č. 89/2012 Sb., zejména nejvýraznějším změnám. Prace se zabývá zejména novou zásadou superficies solo cedit i jejím vlivem na prodej nemovitostí, dále pak definicí nemovitosti. Ale i materiální publicitou, poznámkou spornosti a požadavkem písemné formy při převodu nemovitosti. Diplomová práce v závěru srovnává vybrané instituty a porovnává klady i zápory, jenž nová úprava přinesla. název práce : Úprava prodeje nemovitostí - komparace dle současného občanského zákoníku a dle návrhu nového občanského zákoníku seznam klíčových slov : nemovitost, prodej, zásada superficies solo cedit, materiální publicita, katastr nemovitostí; This thesis analyzes the problem of real property selling in the legal sense under Act No. 89/2012 Coll. compared to Act No. 40/1964 Coll. and also contains their comparison. Firstly, the definition of real property and its transfer under Act 40/1964 Coll. is being examined. This paper deals particularly with new principle of superficies solo cedit and influence it has on real property selling, as well as with real property definition. Further issues covered are material publicity, note of disputability and requirement of written form upon transfer of real estate.
