Lze tedy shrnout, že současná Ústava vykročila důmyslněji směrem k racionalizaci parlamentarismu, než tak učinila Malá ústava z roku 1992. Odstranila totiž třecí plochy, které často vedly ke konfliktům na linii prezident republiky-předseda Rady ministrů, prezident republiky-parlament (byť ne úplně), a to zejména cestou oslabení pozice prezidenta republiky a posílením postavení Rady ministrů a jejího předsedy. Výkonnou moc tak v Polské republice drží výhradně Rada ministrů (srov. čl. 146 Ústavy), kterou reprezentuje a jejíž práce řídí předseda Rady ministrů (srov. čl. 148 Ústavy). Prezident republiky by tak měl v rámci výkonu svých pravomocí plnit výhradně svou funkci hlavy státu, politického arbitra, pouvoir neutre a v souladu se svými ústavními úkoly jako nejvyšší představitel Polské republiky a garant kontinuity státní moci bdít nad dodržováním Ústavy, střežit suverenitu a bezpečnost státu, jakož i nedotknutelnost a nedílnost jeho území. Powered by TCPDF (www.tcpdf.org) The aim of the thesis is to analyse the status of the President of the Republic in Polish Constitutional System. The reason for this research is that although this subject has already been described by political scientists, it has not been fully explored in the field of Theory of Constitutional Law. The institution of the President of the Republic was re-established in 1989 in the course of systemic reforms, therefore the first part of this study describes historical background of this institution. The following parts outline the mode of election, constitutional features of office and constitutional liability of the President of the Republic. The President of the Republic is elected directly by the people and according to the Constitution he is the executive authority and performs three basic functions: 1) representation of the Republic of Poland in both international and home relations and guaranteeing the continuity of state authority (traditional function of Head of State), 2) supervision of the observance of the constitution, 3) protection of the sovereignty and security of the state as well as inviolability and integrity of its territory.
