Diplomová práce pojednává o základních otázkách týkajících se rozhodčího řízení v mezinárodním obchodním styku. Cílem práce je přiblížit základní aspekty mezinárodního rozhodčího řízení, které jsou pro strany konfliktů důvodem pro volbu této metody řešení sporů a následně zhodnotit zda vývoj rozhodčího řízení nemůže subjekty mezinárodního obchodního styku přimět k přehodnocení arbitráže jako primárního způsobu řešení sporů a zapříčinit odklon k jiným metodám řešení sporu. Struktura práce je členěna do úvodu, devíti kapitol a závěru. Po úvodu v němž stanovím tezi diplomové práce, následuje první kapitola, v níž krátce seznamuji čtenáře s historií rozhodčího řízení a rozhodčího řízení v mezinárodním obchodním styku. V druhé kapitole definuji obecně možné druhy řešení sporů. Ve třetí kapitole se věnuji šířeji alternativním metodám řešení sporů, jejich výhodám a následně popisuji některé druhy ADR. Ve čtvrté kapitole vymezuji pojem rozhodčího řízení, jeho základní atributy, uvádím teoretické koncepce rozhodčího řízení a vymezuji rozhodčí řízení mezinárodní a vnitrostátní. Na konci kapitoly uvádím prameny rozhodčího řízení. V kapitole páté popisuji rozhodčí smlouvu jakožto předpoklad rozhodčího řízení, uvádím předpoklady pro platnost rozhodčích smluv a vymezuji jejích druhy. V kapitole šesté pojednávám o... This thesis discusses the fundamental issues of arbitration in international trade. The aim of the paper is to explain the basic aspects of international arbitration, which constitute reason for choosing this method of dispute resolution, and further evaluate whether development of arbitration as such may cause international traders to reconsider arbitration as primary dispute resolution method. The structure of this thesis consists of an introduction, nine chapters and a conclusion. I determine thesis dissertation in the introduction, followed by the first chapter, where the reader is briefly acquainted with the history of arbitration and international commercial arbitration. In the second chapter dispute resolution methods in general are defined. The third chapter is devoted to alternative dispute resolution methods, their advantages and disadvantages and I further describe certain types of ADR. In the fourth chapter, arbitration is explained together with its basic attributes, theoretical concepts of arbitration and definition of international and domestic arbitration. At the end of the chapter legal sources of arbitration are listed. The fifth chapter describes the arbitration agreement as a precondition for arbitration; conditions for the validity of arbitration agreements are further defined as well...
