Resumé Předmětem této diplomové práce je právní problematika "Svěření nezletilého dítěte do výchovy a úprava styku s ním po rozvodu." Práce je zaměřena na právní instrumenty zakotvené v českém právním řádu za účelem ochrany dítěte, jehož rodiče se rozvádějí, event. spolu nežijí. Práce se věnuje historickému vývoji i platné právní úpravě rozvodu, formám porozvodové péče o dítě i styku dítěte s oběma rodiči, resp. s širší rodinou. Důraz je přitom kladen na rozhodovací praxi opatrovnických soudů, i na stěžejní rozhodnutí Nejvyššího a Ústavního soudu České republiky v této věci. V komparaci s českou právní úpravou je popsána též právní úpravu slovenská, a to zejména s ohledem na odlišnosti, které jsou výsledkem již téměř dvacetiletého odděleného vývoje obou právních řádů. Vzhledem k právě probíhající rekodifikaci soukromého práva se práce zabývá též změnami, které by do současné právní úpravy měl přinést s účinností od 1. ledna 2014 nový občanský zákoník. S ohledem na osobní a emocionální charakter vztahů regulovaných rodinným právem nelze ponechat stranou ani psychologické aspekty rozvodu rodičů a následné péče o dítě. Proto se práce okrajově věnuje též psychologickým dopadům rozvodu na dítě i na chování rodičů, jejichž znalost je nezbytná pro opatrovnické soudce, sociální pracovníky, mediátory i advokáty... This Master's degree thesis addresses the issue of "The custody of underage children and the right to be in contact with them." The main attention is paid to the Czech legal instruments concerning the protection of underage children whose parents are getting divorced or do not live together. The thesis deals with the historical Czech legal development as well as the relevant legislation in force, different types of post-divorce care of children, their contact with both parents and other family members. A special emphasis is placed on the established practice of courts as well as relevant key judgments of the Czech Supreme Court and the Czech Constitutional Court. In comparison to the Czech legislation is described also the Slovak divorce regulation. Furthermore, relevant alterations introduced by the new Civil Code coming into effect on 1 January 2014 are considered. Due to the personal and emotional nature of family law relationships, the thesis discusses also the psychological impact of divorce on children and their parent's behavior. These are important especially for judges, social workers, mediators and family law lawyers.
