v českém jazyce Hlavním tématem mé diplomové práce je vypořádání společného jmění manželů a vypořádání vzájemných práv a povinností společného bydlení. V úvodu práce bylo pojednáno obecně o instituci manželství a o majetkových a statusových změnách, které manželství přináší. V další kapitole nazvané společné jmění manželů jsem se zabývala pojmem bezpodílového spoluvlastnictví manželů a jeho nástupcem, společným jměním manželů, vymezila jsem předmět společného jmění manželů a majetek, který do tohoto jmění nepatří. Dále zde bylo pojednáno o správě a hospodaření s majetkem náležejícím do společného jmění manželů, modifikacích společného jmění a manželů a na závěr též o různých způsobech jeho zániku. I když by se na první pohled mohlo zdát, že existence společného jmění manželů je vázána na existenci manželství, zvláštní právní předpisy upravují i další způsoby zániku SJM za trvání manželství. Třetí kapitola mé diplomové práce již pojednává o hlavním tématu práce, kterým je vypořádání společného jmění manželů a jednotlivých způsobech jeho vypořádání. Manželé mohou zvolit pro vypořádání dohodu, mohou požádat o vypořádání SJM soudem nebo pouze čekat, až nastane právní domněnka vypořádání upravená v občanském zákoníku. Čtvrtá kapitola dále pojednává o různých možnostech společného bydlení a o vypořádání... 1 Thesis abstract Settlement of the community property of spouses focused on the settlement of the rights and obligations to joint housing. Community property of spouses is a specific type of property partnership, which can exist only between spouses. The community property of spouses origins and terminates together with the marriage (with the exceptions). The termination of marriage needs to be followed by the settlement of the property. The settlement of the common property is always made on the basis of some legal institute as agreement, judgment or legal presumption. The settlement of the community property of spouses and the settlement of the rights and obligations to joint housing is the main topic of my thesis. The thesis is composed of 5 chapters, each of them dealing with different aspects of the community property of spouses: Chapter One is introductory and generally deals with the marriage. Chapter two called community property of spouses is subdivided into five parts. First part characterizes community property of spouses in general. Second part describes the subject of community property of spouses, i e. things, rights and obligations acquired during the marriage period.
