VYBRANÉ KAPITOLY JURISDIKCE STÁTU V MEZINÁRODNÍM PRÁVU 1 ABSTRAKT Tato disertační práce se věnuje teoretické mezinárodněprávní otázce jurisdikce státu, přičemž institut jurisdikce pojímá jako právní titul pro výkon státní moci, kterou stát může působit na osoby a zakládat, měnit nebo rušit jejich práva a povinnosti. Disertační práce se zabývá rozborem institutu jurisdikce, zkoumá její jednotlivé jurisdikční tituly, možnosti a limity jejich použití a jejich vzájemné vztahy. Mezinárodní jurisdikční právo je upraveno především obyčejovým mezinárodním právem, v oblasti smluvního práva bylo uzavřeno jen několik smluv týkající se mezinárodního práva trestního. Disertační práce je při zkoumání jurisdikčních otázek zaměřena především na oblast trestněprávní. Tomu odpovídá i volba praktických příkladů z trestního práva, které jsou uvedeny u jednotlivých jurisdikčních titulů. Na konkrétních ustanoveních českého trestního zákoníku, rakouského trestního zákoníku a německého trestního zákoníku je dokládán praktický dopad jurisdikční teorie na vnitrostátní právo. Státy jako suverénní subjekty mezinárodního práva jsou oprávněny uplatňovat jurisdikci nejen na svém vlastním území, ale v souladu s mezinárodním právem i mimo území státu. Jurisdikce jednotlivých subjektů mezinárodního práva se mohou dostat do konkurence.... SELECTED TOPICS OF STATE JURISDICTION IN INTERNATIONAL LAW 1 ABSTRACT This study deals with the theoretical question of state jurisdiction under international law. Jurisdiction is defined as the legal title for the exercising of state power which may affect the rights and obligations of persons. The study analyzes jurisdiction, explores the possibilities and limits on the use of the various jurisdictional titles and their interplay. International jurisdictional law is mainly governed by customary international law. Some treaties have been concluded in the field of international criminal law. This study examines the jurisdictional issues focusing mainly on the criminal law. This corresponds with the selection of practical examples from the criminal law, which are listed by each of the jurisdictional titles. The practical impact of the jurisdictional theory on national law is illustrated using the specific provisions of the Czech Criminal Code, Austrian Criminal Code and German Criminal Code. States as sovereign subjects of international law are entitled to exercise jurisdiction not only within their own territory, but also, in accordance with international law, outside their own territory.
