1 Dohledová činnost České národní banky (se zaměřením na ochranu spotřebitele na finančním trhu) Tato práce se zabývá ochranou spotřebitele na finančním trhu v České republice. V úvodní části práce stručně popisuje stav právní úpravy před r. 1989. Tehdy vládnoucí společenský systém neumožňoval významnější ekonomické aktivity, finanční trh byl značně omezen, a tedy ani právní úprava ochrany spotřebitele nemusela být rozsáhlá. Ochrana spotřebitele nabyla na významu po přechodu k tržnímu modelu hospodářství. S rozvojem trhu včetně trhu finančního bylo třeba přijmout i takovou právní úpravu, která by lépe odpovídala novým podmínkám. S ohledem na tehdy připravovaný vstup České republiky do Evropských společenství bylo třeba při vytváření českého práva toto právo harmonizovat i s právem evropským. Kromě změny občanského zákoníku jako základního předpisu soukromého práva byla přijata i právní úprava speciální, jako zákon o ochraně spotřebitele nebo zákon o spotřebitelském úvěru. V souvislosti s vytvořením kapitálového trhu bylo třeba přijmout zcela novou úpravu kapitálového trhu i úpravu týkající se osob podnikajících na tomto trhu. Důležitou součástí práva týkajícího se kapitálového trhu je i úprava dohledu nad kapitálovým trhem a jeho ochrana prostřednictvím správního práva. S ohledem na skutečnost, že se Česká... 1 On Supervision of Financial Markets by Czech National Bank (focused on Consumer Protection in the Financial Markets) This work deals with the consumer protection in the financial markets in the Czech Republic. The opening part of this thesis briefly describes the situation in Czech(oslovak) legislation before 1989. The governing system was not at that time conducive to significant economic activity and the scope of financial markets was limited. As a consequence, legislated protection of market participants had not to be extensive. Need for consumer protection increased after the then-prevailing economic model had been changed into the current market-oriented model. The expansion of economic activities, including the development in the financial markets, necessitated simultaneous passing of updated law more suited for the new social circumstances. Owing to the preparation of the Czech Republic's entry into the European Economic Community at that time, it was necessary to harmonize the new Czech law with the laws of the Community. Besides the change of the "Code civil" as a basic regulation of private law, new specific regulations have been passed - for example the Consumer Protection Act or the Consumer Credit Act.
