[cze][eng] Souběhy přestupků a jejich trestání Abstrakt Jak již téma napovídá, tato diplomová práce se zabývá souběhy přestupků a jejich trestáním. Cílem práce je komplexní představení této problematiky a analýza veškerých jejích aspektů, ať už těch hmotněprávních či procesněprávních. Součástí je kritický náhled na právní úpravu a vytknutí jejích nedostatků. Práci lze rozdělit na dva hlavní segmenty, a to na segment věnující se souběhům jako takovým a na segment týkající se trestání takovýchto souběhů, tedy jednotlivých specifik v oblasti ukládání trestů a vedení přestupkového řízení. První část práce se ve stručnosti věnuje vztahu přestupkového a trestního práva a vysvětluje, proč lze v mnohých dalších částech práce použít závěry vyvozené trestněprávní literaturou a judikaturou. Druhá část se pak konečně věnuje souběhu jako takovému, a to včetně definice skutku, která je pro souběhy stěžejní. Ve třetí části je pak popsáno dělení souběhů, na souběhy jednočinné a vícečinné a souběhy stejnorodé a nestejnorodé. S tím pak souvisí část čtvrtá, která se věnuje případům, které sice vypadají jako souběhy přestupků, z určitých důvodů je však souběh mezi těmito přestupky vyloučen. V páté části je pak v krátkosti představena problematika souběhu trestného činu s přestupkem. Stěžejní část týkající se trestání pak nalezneme v...Concurrent infractions and their sentencing Abstract As the title of the thesis suggests, this work is concerned with the concurrence of administrative infractions and how it is penalized. This work aims to be a complex introduction into these issues and an analysis of all related aspects, in terms of both substantive and procedural law. A critical review of current legislation is also part of the analysis and the insufficiencies in the current system are identified. The thesis can be divided into two main sections: the first section is concerned with an analysis of concurrence itself while the second section analyses the penalization of such concurrences, concretely it explores the specifics of imposing penalties and of the infraction proceedings themselves. The first part of the thesis is concerned with the relationship of the administrative infractions law and the criminal law, and it explains why the judicial conclusions of the criminal law and its associated literature are often applicable to administrative infraction cases as well. In the second part, a discussion of the concurrence itself is presented together with a definition of act, which is a crucial definition for proper discussion of concurrence.
