Závazná stanoviska jako nástroj ochrany životního prostředí Abstrakt Diplomová práce se zabývá závaznými stanovisky vydávanými v oblasti životního prostředí. Jejím primárním cílem je zhodnotit, zdali závazná stanoviska plní roli efektivního a vhodného nástroje ochrany životního prostředí, a to v návaznosti na přijatou reformu veřejného stavebního práva. Vedle nečíslovaného úvodu a závěru se člení na čtyři části. První část pojednává o závazných stanoviscích z pohledu obecného správního práva a jejich zakotvení ve správním řádu. Konkrétně se zaměřuje na jejich obecné vymezení, proces vydávání a otázky přezkumu jak ve správním řízení, tak v soudním řízení správním. Druhá část poskytuje základní vymezení dotčených orgánů s důrazem na úpravu postavení dotčených orgánů působících na úseku životního prostředí. Věnuje se zejména jejich institucionálnímu zakotvení a pravomocem. Neopomíná ani představení několika řízení podle různých právních předpisů, v nichž dotčené orgány vystupují. Zároveň představuje základní změny na úseku dotčených orgánů, které přinese reforma veřejného stavebního práva. Jelikož se závazná stanoviska nejčastěji uplatňují v procesech spojených se stavebním právem, je třetí část zaměřena na vybrané otázky vztahu závazných stanovisek a stavebního práva. Třetí část se proto zaobírá problematikou... Binding Opinions as an Instrument of the Environmental Protection Abstract The thesis deals with binding opinions issued in the field of environment. Its primary objective is to evaluate whether binding opinions fulfil the role of an effective and appropriate instrument of environmental protection in the context of the adopted reform of public building law. In addition to an unnumbered introduction and conclusion, it is divided into four parts. The first part deals with binding opinions from the perspective of general administrative law and their enshrinement in the Administrative Procedure Code. In particular, it focuses on their general definition, the process of issuing and the issues of review in both administrative proceedings and administrative court proceedings. The second part provides a basic definition of the respective authorities, with an emphasis on the regulation of the status of the respective authorities in the field of the environment. It focuses in particular on their institutional setting and powers. It does not fail to introduce several proceedings under various laws in which the respective authorities are involved.
