Právo na obhajobu v trestním řízení a jeho limity Abstrakt Diplomová práce se zabývá jedním ze základních lidských práv osoby, proti níž se vede trestní řízení, a to právem na obhajobu a jeho limity v trestním řízení v České republice, neboť jedině uplatněním práva na obhajobu jako dílčího prvku práva na spravedlivý proces, je možno docílit spravedlivého a zákonného rozhodnutí ve věci. Práce se v první kapitole zabývá nejen vnitrostátní právní úpravou na zákonné a ústavní úrovni, ale také zakotvením práva na obhajobu v mezinárodních lidskoprávních dokumentech, konkrétně v Úmluvě o ochraně lidských práv a základních svobod a Mezinárodním paktu o občanských a politických právech, a v právních předpisech Evropské Unie. V další části práce jsou rozebrány jednotlivé složky práva na obhajobu, mezi něž patří obhajoba materiální, obhajoba formální včetně institutu nutné obhajoby a povinnost orgánů činných v trestním řízení. Kapitola je dále doplněna o veškerá významná práva obviněného, která může uplatnit v rámci jednotlivých stádií trestního řízení, mezi která patří například právo obviněného vyjádřit se ke všem skutečnostem, které jsou mu kladeny za vinu, právo činit návrhy a podávat žádosti či opravné prostředky, právo nahlížet do spisu nebo právo mít obhájce a radit se s ním. The Right of Defence in the Criminal Proceedings and its Limits Abstract The thesis deals with one of the fundamental human rights of a person againts whom the criminal proceeding is being conducted, namely the right of defence and its limits in the criminal proceedings in the Czech Republic, because only by exercising the right of defence as a partial element of the right to a fair trial, it is possible to achieve a fair and lawful decision in the matter. The first chapter of the thesis deals not only with the national legislation on the legal and constitutional level, but also with the enshrinement of the right of defence in the international human rights agreements, specifically in the European Convention of Human Rights and in the International Covenant on Civil and Political Rights, and in the regulations of the European Union. The next part of the thesis discusses the various components of the right of defence which include material defence, formal defence including the compulsory defence and the duty of the authorities participating in the criminal proceedings.
