Odposlech a záznam telekomunikačního provozu Abstrakt Diplomová práce se zabývá institutem odposlechu a záznamu telekomunikačního provozu, jež si neustálým rozvojem technologií zasluhuje bližší pozornosti. Cílem práce je tak analyzovat hlavní problémy úpravy institutu nejen dle stěžejní trestně procesní normy, ale i dle jiných zákonů, a to zejména v kontextu ústavněprávních limitů. Práce je rozdělena do pěti kapitol. V počáteční kapitole se autorka nejprve stručně věnuje odposlechu telekomunikačního provozu z pohledu technologického, s tím, že pokračuje analýzou vývoje odposlechu a záznamu telekomunikačního provozu prvně z pohledu právní úpravy zahraniční a posléze právní úpravy v českém právním řádu. Je tak zohledněn nejen historický vývoj §88 a §88a trestního řádu od roku 1990, ale i paralelní úprava odposlechu v Zákoně o Policii z roku 1991. V druhé kapitole autorka nastíní základní ústavněprávní mantinely, a to z pohledu Listiny, ale i dle Úmluvy, a s tím související obsáhlé judikatury Evropského soudu pro lidská práva. Ve stěžejní třetí kapitole autorka zkoumá úpravu odposlechu a záznamu telekomunikačního provozu dle platného práva, s tím, že se neomezuje pouze na úpravu de lege lata, nýbrž nabízí i úvahy de lege ferenda. Jsou tak analyzovány především §88 a §88a trestního řádu, ale i ustanovení... Wiretapping and recording of telecommunication traffic Abstract The thesis deals with the institute of wiretapping and recording of telecommunication traffic, which deserves closer attention due to the constant development of technologies. The aim of the thesis is to analyse the main issues of the regulation not only according to the pivotal criminal procedure norm, but also according to other acts, especially in the context of constitutional limits. The thesis is divided into five chapters. In the initial chapter, the author briefly deals with wiretapping of telecommunications traffic from a technological perspective followed by an analysis of the development of wiretapping and recording of telecommunications traffic, in terms of foreign legislation and then Czech legal system. It takes into account not only the historical development of §88 and §88a of the Criminal Procedure Code but also the parallel regulation of wiretapping in the Police Act of 1991. In the second chapter, the author outlines the constitutional limits not only in the terms of the Charter but also according to the Convention and the related case law of the European Court of Human Rights.
