Abstrakt: [cze][eng] Diplomová práce se věnuje nejčastěji páchanému daňovému trestnému činu, a sice trestnému činu zkrácení daně, poplatku a podobné povinné platby podle § 240 trestního zákoníku. Cílem práce je pozastavit se nad vybranými problematickými aspekty právní úpravy tohoto trestného činu a upozornit na vyskytující se rozkolísanost aplikační praxe. Pozornost je věnována hmotněprávní i procesní stránce, relevantní judikatuře tuzemských soudů i názorům odborné veřejnosti. Práce je rozdělena do pěti kapitol doplněných o úvod a závěr. První dvě kapitoly mají obecný charakter a jejich smyslem je vysvětlit hmotněprávní základ tématiky, stručně popsat historický vývoj daňových trestných činů a v neposlední řadě podtrhnout význam a aktuálnost celého tématu za pomoci veřejně dostupných statistických dat. Třetí kapitola je zaměřena na vzájemný vztah trestného činu podle § 240 trestního zákoníku a dvou vybraných trestných činů. Prvním je trestný čin neodvedení daně, pojistného na sociální zabezpečení a podobné povinné platby podle § 241 trestního zákoníku se zaměřením na institut účinné lítosti u obou trestný činů. Zde je nastíněn mj. problém navazující na bezprecedentní nález Ústavního soudu v otázce dobrovolnosti jednání pachatele či projev aplikace účinné lítosti v daňovém řízení. Druhým je trestný čin zkreslování...This thesis describes the most commonly committed tax criminal offense i.e., the evasion of taxes, fees, and other mandatory payments pursuant to Section 240 of the Criminal Code. The goal of the thesis is to examine the problematic aspects of this criminal offense and to call attention to the discrepancies in proceedings and judgements, with special attention to substantive and procedural aspect, relevant case law of the domestic courts, and the opinion of professional public. The body of the thesis is divided into five chapters. The first two chapters introduce the substantive basis of the topic, provide a brief overview of the history of tax crimes and, last but not least, underline the importance and relevance of the whole topic using publicly available statistical data. The third chapter is focused on the mutual connection between the criminal offense pursuant to Section 240 of the Criminal Code and two selected criminal offenses. The first being the non-payment of taxes, social security contributions and similar mandatory payments pursuant to Section 241 of the Criminal Code, with a focus on the role of effective regret.
