[cze][eng] Sovětské právní myšlení ve 20. a 30. letech 20. století a jeho kritické zhodnocení Záměrem předkládané práce je představit život a dílo tří předních sovětských právních teoretiků a vědců: Pēterise Ivanoviče Stučky, Jevgenije Bronislavoviče Pašukanise a Andreje Januarjeviče Vyšinského, kteří zásadní měrou formovali sovětské právní myšlení 20. a 30. let 20. století. Práce si klade za cíl představit jejich myšlenky a právní teorie, kriticky je zhodnotit z pohledu dnešní právní vědy a ukázat, že každý, kdo slouží právu, nemusí sloužit dobru. Práce je rozdělena (kromě úvodu a závěru) do tří částí, kde každá část je věnována jednomu ze zkoumaných právních teoretiků a vědců. První část je tak věnována Pēterisovi Stučkovi, druhá část Jevgeniji Pašukanisovi a třetí část Andreji Vyšinskému. Každá z těchto částí se poté dělí do dvou kapitol: životopisné kapitoly a kapitoly zkoumajících jejich právní teorie a postoje. Jednotlivé životopisné kapitoly se zaměřují na životní dráhy P. Stučky, J. Pašukanise a A. Vyšinského, jejich vědecké a akademické kariéry. Postupně jsou zmapovány jednotlivé etapy jejich života a také vyvráceny některé zažité nepravdy a mýty. Ač se může na první pohled zdát, že zkoumání životních drah jednotlivých právních vědců je nepodstatné, opak je pravdou. Jejich život a kariéra jsou naopak...Soviet jurisprudence of the second and third decade of the 20th century and its critical assessment The presented thesis aims to introduce the life and work of three prominent Soviet legal scholars: Pēteris Ivanovich Stuchka, Evgeny Bronislavovich Pashukanis, and Andrey Yanuaryevich Vyshinsky, who has a significant impact on formulating Soviet legal thinking of the second and third decade of the 20th century. The thesis undertakes to present their ideas and legal theories, subject them to critical analysis and evidence that not everyone who serves the law also serves the good. The thesis is divided (except for the introduction and end parts) into three parts, each of which is dedicated to one of the examined scholars. The first part is dedicated to Pēteris Stuchka, the second part to Evgeny Pashukanis and the third part to Andrey Vyshinsky. Each of these parts is then divided into two chapters: a bibliographical chapter and a chapter examining their legal theories and opinions. Each of the bibliographical chapters focuses on the life of P. Stuchka, E. Pashukanis, and A. Vyshinsky, and their scientific and academic careers.
