Vztah nájemce a pronajímatele ve srovnání se službou Airbnb Abstrakt Cílem mé diplomové práce je zanalyzování materie nájmu dle obecných i zvláštních ustanovení Občanského zákoníku spolu s poukázáním na rozdílnou a dnes velice problematickou právní úpravu online služby Airbnb. Jelikož mají ustanovení o nájmu silně protekcionistickou povahu vůči nájemci, který je ve vztahu k pronajímateli slabší smluvní stranou, rozvádím i stěžejní práva a povinnosti každé ze smluvních stran. Základním pramenem diplomové práce je nejen Občanský zákoník spolu s dalšími vnitrostátními předpisy, které nám dnes již detailně upravují většinu institutů s nájmem souvisejících, ale i neopomenutelná zahraniční právní úprava, která je především v souvislosti se službou Airbnb velice zajímavým zdrojem inspirace pro budoucí vývoj nejen na území České republiky. Vlastní text je rozdělen do pěti částí. První z nich definuje nájem dle obecných ustanovení Občanského zákoníku spolu s jeho podstatnými znaky, které tak umožňují snadnější pochopení speciální úpravy o nájmu bytu a domu. Také odpovídá na otázku, v jakých právních předpisech nalezneme jedno ze základních lidských práv, a to právo na bydlení. Druhá část pojednává o online službě Airbnb, která je i nadále jedním z nejprobíranějších a nejaktuálnějších témat ve vztahu k bydlení a... The relationship between lessee and lessor compared to Airbnb service Abstract The aim of this diploma thesis is to analyze the legal aspects of lease pursuant to the general and special provisions of the Civil Code as well as to point out the different and currently ambiguous legislation of the Airbnb online service. As the lease provisions are strongly protectionist in relation to the lessee, who stands as a weaker party to the lessor, I also elaborate on the fundamental rights and obligations of each of the parties. Not only the Civil Code together with other national provisions, which now regulate in detail most institutes related to lease, represent a basic source of the diploma thesis, but also an unforgettable foreign legislation, which is especially with regard to the Airbnb service a very interesting source of inspiration for the future development not only in the Czech Republic. The content itself is divided into five parts. The first of them defines the lease according to the general provisions of the Civil Code together with its essential characteristics, which thus enables an easier understanding of the special regulation of the residential lease.
