[cze][eng] Trestný čin podvodu podle § 209 trestního zákoníku Abstrakt Tématem této diplomové práce je trestný čin podvodu podle § 209 trestního zákoníku. Trestný čin podvodu je jedním z majetkových trestných činů, jejichž podíl na celkové kriminalitě v České republice je vysoký. Diplomová práce se zaměřuje na poskytnutí uceleného přehledu a analýzu skutkové podstaty trestného činu podvodu a také se soustředí na problémy vznikající v aplikační praxi. Práce je členěna do sedmi logicky uspořádaných částí. V první části je stručně popsán historický vývoj trestného činu podvodu od raného feudalismu až do vývoje po roce 1989. Druhá část práce už je věnována současné právní úpravě trestného činu podvodu, kdy nejdříve dochází k obecnému zařazení do majetkových trestných činů a následně k rozebrání znaků skutkové podstaty trestného činu podvodu. V souvislosti s objektivní stránkou je více rozebrána problematika určování výše škody, význam možnosti poškozeného vyvarovat se omylu a možnost, resp. nemožnost, spáchat trestný čin podvodu vylákáním dluhu. V rámci této části je také uvedena kapitola zabývající pokračováním trestného činu podvodu a kapitola zabývající se zásadou subsidiarity trestní represe, neboť jde o zásadu ovládající celé trestní právo, a má tak souvislost i s tématem trestného činu podvodu. Třetí část se pak...The crime of fraud pursuant to Section 209 of the Criminal Code Abstract The topic of this Diploma Thesis is the crime of fraud pursuant to Section 209 of the Criminal Code. The crime of fraud is one of the property crimes, a category of offences with a high share in total crime in the Czech republic. The Diploma Thesis provides a comprehensive overview and analysis of the substance of the offence of the crime of fraud and focuses on problems present in today's application practice. The Thesis is divided into seven logically arranged parts. The first part briefly describes the historical development of the crime of fraud from early feaudalism to post-1989 development. The second part of the Thesis addresses current legislation governing the crime of fraud, it opens with a general classification of property crimes and continues with an analysis of the constituent elements of the crime of fraud. From the objective point of view, the issue of determining the amount of damage, the importance of the injured party's ability to avoid mistakes and the possibility, or impossibility, to commit the crime of fraud by luring debt are more discussed.
