[cze][eng] Režim uznání a výkonu rozhodčích nálezů podle Newyorské úmluvy Abstrakt Cílem práce je seznámení s problematikou čl. III Newyorské úmluvy a jeho recepcí v rámci českého právního řádu, a stejně tak seznámení se související judikaturou Nejvyššího soudu České republiky. Tento článek umožňuje Smluvním státům stanovit vlastní procesní pravidla stricto sensu ve vztahu k uznání a výkonu cizího rozhodčího nálezu spadajícího do působnosti Newyorské úmluvy, avšak toliko za podmínek v této vyložených. Jednou z nich je i podmínka obsažená právě v čl. III Newyorské úmluvy zakazující stanovit taková pravidla, která by kladla podstatně tíživější podmínky a vyšší soudní poplatky než pro rozhodčí nález místní. Smluvní stát je tak na jednu stranu sice oprávněn svobodně nastavit vlastní režim pro uznání a výkon cizího rozhodčího nálezu, na druhou stranu je však při tomto povinen respektovat podmínky v Newyorské úmluvě stanovené. Podstatou práce je tedy zhodnotit postavení cizích rozhodčích nálezů, ve srovnání s místními rozhodčími nálezy, a to ve vztahu k jejich uznání a výkonu na území České republiky. Práce se nejprve zabývá vymezením účelu samotné Newyorské úmluvy s tím, že na to navazuje rozbor jejího čl. III, který je zákadním prvkem celé práce. Následující část zabývající se českou právní úpravou civilního vykonávacího...Regime for the recognition and enforcement of arbitral awards under the New York Convention Abstract The aim of this thesis is to introduce the issue of Article III of the New York Convention and its reception into the Czech legal system, including the stance of the Czech courts on this issue. This particular Article enables Contracting States to establish their own procedural rules stricto sensu regarding the recognition and enforcement of foreign arbitral awards to which the New York Convention applies. However, these rules shall be in compliance with the conditions laid down in the Convention, such as, in particular, the prohibition to impose substantially more onerous conditions or higher fees or charges than those imposed on domestic arbitral awards. Therefore, on the one hand, the Contracting State is given the right to define its own regime for the proceedings of the recognition and enforcement of foreign arbitral awards, but on the other hand, there are also substantial limitations, given that the rules shall not conflict with the New York Convention's provisions.
