Řízení o žalobě proti rozhodnutí správního orgánu Abstrakt Předmětem disertační práce je rozbor právní úpravy poskytující ochranu veřejným subjektivním právům prostřednictví prostřednictvím řízení o žalobě proti rozhodnutí správního orgánu, upraveného soudním řádem správním, a posouzení, zda právní úprava poskytuje dostatečnou právní ochranu veřejným subjektivním právům, s doporučením možností její úpravy. Základní metodu představují převážně logické metody při současné kombinaci normativního přístupu, kdy je stávající právní úprava podrobena podrobné analýze a syntéze ve spojení s empirickým zkoumáním poskytované ochrany v rámci problematických okruhů prostřednictvím již proběhlých soudních řízení a rovněž srovnáním problémových institutů se zahraniční právní úpravou. Prvním modelem se tak stala "tradiční" německá právní úprava správního soudnictví, v níž se zákonodárce tradičně inspiruje. V této souvislosti nemohla být opomenuta nově přijatá verze správního soudnictví na Slovensku. Ta, byť navazuje na historické kořeny "našeho" správního soudnictví z doby prvé republiky, k řadě institutů však přistupuje odlišným způsobem. Výkon správního soudnictví soudy zdaleka převyšuje standard českého soudnictví. Přesto se mi v rámci prováděného zkoumání podařilo analyzovat problémové okruhy správního soudnictví, mezi... Proceeding of Action against Decision of Administrative Authority Abstract The subject-matter of this dissertation thesis is the analysis of the legislation providing protection to public subjective rights in proceeding of action against the decision of an administrative body defined in Code of Administrative Justice, and assessment as to whether the protection provided to public subjective rights by the legislation is sufficient, including certain recommendations of possible changes. The basic method applied consists of the logical methods in combination with the normative approach, involving a detailed analysis and synthesis of the existing legislation and empirical examination of the offered protection in the problem areas on the basis of past judicial proceedings and also comparison of the discussed concepts with foreign legal regulations. The first model was the "traditional" German administrative justice legislation, which is the legislator's usual source of inspiration. In relation to this issue, one must not also disregard the newly adopted legislation on administrative justice in Slovakia.
