Cílem této práce je propojit teoretickou rovinu autorského práva s konkrétní oblastí. Konkrétně se pak jedná o analýzu vztahu mezi autorským právem a reklamní tvorbou. V práci hledám odpověď na dvě zásadní otázky, a to zda je možno reklamní sdělení autorskoprávně chránit a pokud ano, zda je tato ochrana účelná a praktická. Druhá otázka má pak těžiště v analýze užívání již existujících autorských děl v rámci reklamního sdělení. Práce je rozdělena do osmi kapitol, které se dále člení na jednotlivé subkapitoly. První kapitolu věnuji autorskému právu, přičemž popis stávající právní úpravy doplňuje rozbor historického a sociálního kontextu vývoje autorského práva. Druhá kapitola se zaměřuje na pojem reklama. Vysvětlení tohoto pojmu bylo nutné, jelikož právní úprava reklamu definuje jen obecně a pro účel této práce nedostatečně, přistoupil jsem tedy k objasnění tohoto pojmu z hlediska marketingového. Třetí kapitola v teoretické rovině popisuje platnou právní úpravu autorského díla v autorském zákoně. Ve čtvrté kapitole lze spatřit první průnik mezi zdánlivě nesouvisejícími oblastmi: reklamou a autorským právem. Je zde představen pojem reklamní dílo, přičemž se věnuji nejen jeho účelnosti, ale i procesu, který vede ke vzniku reklamních - autorských děl. Je zde také komparativní odbočka k právnímu řádu... The Aim of this thesis is to link the theoretical aspects of copyright with its practical use. Specifically it is an analysis of relationship between copyright and advertising. In the thesis I am trying to find an answer for two main questions. First, if it is possible to grant a copyright protection to an advertisement and if so, then it is my goal to discover its usefulness. Second, the other answer should be based on analysis of preexisting copyrighted works used in advertisement. The thesis is divided into 8 chapters which consist of other sub- chapters. The first chapter is dedicated to copyright, its legal framework and analysis of historical and social background of its development. The second chapter is focused on advertising. Since the definition of advertising offered by the Czech laws is insufficient for the purpose of this thesis I decided to offer a marketing point-of-view to clarify the subject. The third chapter offers an analysis of current legislation of copyrighted work in the Czech Republic. The fourth chapter represents the first encounter of the two ostensibly unrelated topics: advertising and copyright.
