Právo na osobní svobodu v kontextu azylového práva Evropské unie Mgr. Miloš Kulda Abstrakt Právo na ochranu osobní svobody se řadí mezi ta nejdůležitější základní práva každého jedince. Bohužel, zásahy do tohoto práva současně představují jeden z aspektů, který všeobecně provází oblast azylu a nucené migrace osob. Evropský kontinent v tomto ohledu není výjimkou. Tématem této práce proto je: právo na osobní svobodu v kontextu azylového práva Evropské unie. Cílem práce je zejména zhodnotit úroveň ochrany, která je v rámci Evropské unie poskytována žadatelům o azyl a jiným nuceným migrantům - tj. odmítnutým žadatelům o azyl a tzv. neregulérním migrantům - před neoprávněným zbavením jejich osobní svobody. Tento výzkum je přitom prováděn ve světle jak unijního práva, tak Evropské úmluvy o ochraně lidských práv a základních svobod. Těžiště práce proto stojí na dvou hlavních pilířích. Prvním je úprava zbavení osobní svobody žadatelů o azyl a jiných nucených migrantů dle čl. 5 Úmluvy a související judikatury Evropského soudu pro lidská práva. Druhým pilířem je poté úprava zbavení osobní svobody výše uvedených skupin osob dle unijního práva, tedy podle úpravy obsažené zejména v čl. 6 Listiny základních práv Evropské unie a dále pak v rámci konkrétních předpisů sekundárního unijního práva, především v tzv. azylových... Miloš Kulda Abstract: Right to personal liberty is considered to be one of the most important fundamental rights of a person. Unfortunately, the interferences to this right also constitute one of the aspects that generally accompanies asylum and forced migration. Europe is no exception in this respect. The topic of this theses is as follows: Right to Personal Liberty in the Context of the Asylum Law of the European Union. The objective of the theses is particularly to assess the level of protection which is provided within the European Union to asylum seekers and other forced migrant - i.e. refused asylum seekers and so called irregular migrants - against unauthorised deprivation of their liberty. The research is performed in the light of both the European Union law and European Convention for the Protection of Human Rights and Fundamental Freedoms. The focus of the thesis stands on two main pillars. The first one are the rules concerning the deprivation of liberty of asylum seekers and other forced migrants according to Art. 5 of the Convention and related case-law of the European Court of Justice.
