Cílem této práce je zodpovědět otázku, zdali platy soudců představují ústavní záruku soudní nezávislosti, a tedy zda mohou mít reálný vliv na rozhodování soudců. S ohledem na to, se bude diplomová práce nejprve zabývat definicí pojmu soudní nezávislost a jejími možnými způsoby kategorizace. Následně bude představena česká právní úprava hmotného zabezpečení soudců a dokumenty významných mezinárodních institucí upravující doporučení k této problematice. Stěžejní částí práce pak bude kapitola věnovaná analýze zákona č. 236/1995 Sb., o platu a dalších náležitostech spojených s výkonem funkce představitelů státní moci a některých státních orgánů a soudců a poslanců Evropského parlamentu, ve znění pozdějších předpisů, a judikatury Ústavního soudu k otázce odměňování soudců, a to zejména s důrazem na způsob určování soudcovských platů a restriktivní zásahy do platové sféry soudců zahrnující odjímání dalších platů, zmražování platů a změny statistického indexu. Snahou této kapitoly bude zejména zjistit, zdali česká legislativa a judikatura předznamenává existenci záruky hmotného zabezpečení soudců. V rámci této diplomové práce bude zároveň zhodnocen přístup České republiky k odměňování soudců ve vztahu k jiným státům, a to konkrétně ke Slovenské republice, Polské republice a Spojeným státům americkým. The aim of this work is to answer the question of whether the judge's remuneration represent a constitutional guarantee of judicial independence and thus whether they can have a real impact on the judges' decisions. In view of this, the thesis will first deal with the definition of the term "judicial independence" and its possible categorizations. Subsequently, the diploma thesis will focus on Czech legal regulation of judicial remuneration and documentation from important international institutions. The focus of this thesis will be devoted to the analysis of Act No. 236/1995 Sb., o platu a dalších náležitostech spojených s výkonem funkce představitelů státní moci a některých státních orgánů a soudců a poslanců Evropského parlamentu, ve znění pozdějších předpisů (about salary and other elements associated with the performance of State representatives, bodies, judges and members of the European Parliament duties).
