[cze][eng] Vzájemné uznávání versus harmonizace - vývoj a perspektivy trestního práva v EU Abstrakt Trestní právo, které bylo dlouhou dobu mimo pozornost hlavního proudu evropského integračního procesu, je v současné době považováno za jednu z nejrychleji se rozvíjejících sfér unijního práva. Práce se v 8 kapitolách zaměřuje na vývoj a perspektivy trestního práva v EU prostřednictvím analýzy dvou hlavních forem, jimiž se spolupráce členských států v této oblasti rozvíjí, kterými jsou vzájemné uznávání a harmonizace. Po úvodní části se druhá a třetí kapitola nejprve věnují historickým kořenům spolupráce členských států v oblasti trestního práva a popisu a zdůvodnění stávajícího právního rámce trestního práva EU, který byl nastaven vstupem Lisabonské smlouvy v platnost v roce 2009. Klíčovými pojmy, na něž je soustředěna pozornost práce, jsou zásada vzájemného uznávání a harmonizace, každé z nich je proto věnována jedna ucelená kapitola (vzájemnému uznávání čtvrtá, harmonizaci pátá). Kapitola o vzájemném uznávání poukazuje na jeho původ, důvody pro užití zásady vzájemného uznávání v trestní oblasti, zaměřuje se na její základní charakteristiky a vzájemnou důvěru jako ústřední pojem vzájemného uznávání, popisuje všechny dosud přijaté nástroje vzájemného uznávání a tyto instrumenty na základě zvolených relevantních...Mutual recognition versus harmonization - development and perspectives of the criminal law in the EU Abstract The criminal law, which stood away from the attention of the mainstream European integration process for a long time, is at present considered one of the fastest growing spheres of the Union law. The thesis focuses in 8 chapters on the development and perspectives of the criminal law in the EU by analysing two main forms of the development of the member states' cooperation in this area, which are mutual recognition and harmonization. After an introductory part the second and third chapters at first pursue historical roots of the member states' cooperation in the area of the criminal law and the description and justification of the current legal framework of the EU criminal law, which has been set up by the entry into force of the Lisbon Treaty in 2009. The key notions this thesis focuses on are the principle of mutual recognition and harmonization, therefore a comprehensive chapter deals with each of these terms (chapter four with mutual recognition, chapter five with harmonization).
