Ústavní systém ve Spojeném království bývá, s ohledem na svou příslušnost do angloamerické právní kultury, zřídkakdy předmětem zájmu zdejších akademických debat. To je dle autora diplomové práce škoda, protože jeho poznání a interpretace může být v lecčems obohacující i pro tuzemskou doktrínu. Přichází proto s textem, který má ambici popsat ústavní vývoj historický a především pak současnou podobu britského ústavního práva s důrazem na jeho koexistenci s právem evropským. Co se týče systematiky práce je postupováno chronologicky, tedy po úvodních kapitolách, kde jsou vymezeny samotné právní předpoklady Brexitu pohledem common law i pohledem kontinentálním, se zabývá aktuální ústavně-právní kazuistikou, aby v poslední části zkoumala budoucí právní vývoj. Těžištěm práce je právní deskripce a analýza vystoupení Spojeného království z Evropské unie, přičemž jsou rozebírány jak nejrůznější aspekty vnitrostátního práva, tak právo mezinárodní, resp. právo EU. Za pomoci převážně zahraniční literatury a národní i evropské judikatury se pak autor pokouší o jakousi legislativní predikci. Konkrétně se potom zabývá problematikou uzavírání mezinárodních smluv před i po vystoupení z evropského společenství, otázkou základních lidských práv a jejich uplatňování po odchodu z EU a záležitostmi devoluce (decentralizace), tedy... Constitutional system of the United Kingdom is seldom a theme of interest in domestic academic debates for it is usually considered as a part of Anglo-American juridical culture. According to the author of this master thesis, it is a pity, because the study and interpretation of the British constitutional system can enrich in some respects the current domestic doctrine. Master thesis has the ambition to describe British historical constitutional development, and particularly the current state of the British constitutional law and to emphasise its co-existence with the European law. The approach of the thesis is chronological. Thus, in introductory chapters there are indicated the juridical preconditions of Brexit from both the common law perspective and also the continental law perspective and there is also considered the actual constitutional case report. The last part analyses possible future juridical development. The thesis is focused on the description and the analysis of the withdrawal process of the United Kingdom from the European Union and it considers a variety of aspects of domestic law, international law and law of the European Union.
