Náklady řízení při soudním uplatňování pohledávek Abstrakt Tato rigorózní práce je věnována nákladům občanského soudního řízení. Práce se však zabývá pouze těmi náklady řízení, které vznikají účastníkům řízení a souvisejí s uplatňováním pohledávek u soudu. Otázka nákladů řízení je často chápána jen jako nepodstatná vedlejší linie soudního řízení, avšak je třeba si uvědomit, že rozhodování o náhradě nákladů řízení je integrální součást civilního řízení jako celku. Pokud soud rozhodne o náhradě nákladů řízení v rozporu s průběhem řízení, nebo s výrokem ve věci, může tím citelně zasáhnout do ústavně zaručených práv účastníků řízení a tento postup je pak třeba označit za zásah do práva na spravedlivý proces ve smyslu článku 36 odstavce 1 Listiny. Práce je rozdělena na pět částí - úvod, další tři kapitoly a závěr. V úvodu se práce zabývá především významem nákladů řízení. Druhá část práce je věnována definici nákladů řízení, jednotlivým druhům nákladů řízení, institutu osvobození od soudních poplatků a dále rozdílu mezi placením nákladů řízení a jejich náhradou. Třetí část se zabývá náklady řízení a rozhodování o nich v jednotlivých fázích občanského soudního řízení. Čtvrtá část práce se týká nákladů řízení při soudním výkonu rozhodnutí, respektive exekuci. Závěr práce pak obsahuje shrnutí rozebírané... Costs of Proceeding in Seeking Payment of Claims in Court Abstract This rigorous thesis is focused on the costs of civil trial proceeding. The work only deals with the costs of proceeding which are arisen to the parties and related to seeking payment of claims in court. The issue of the costs of proceeding is often understood as only a minor aspect of the court proceeding, but it must be noted that the decision on the costs of proceeding is an integral part of the civil proceeding as a whole. If the court decides to reimburse the costs of proceedings in disregard of the course of the proceedings and the statement at issue, it may significantly interfere with the constitutionally guaranteed rights of the parties as the right to fair trial. The thesis is divided into introduction, three other chapters and conclusion. In the introduction the thesis deals with importance of costs of proceeding. The second part of this work is dedicated to definition of costs of proceeding, various types of costs of proceeding, institute of court fee liberation and differences between paying costs of proceeding and reimbursement of costs of proceeding.
