Dopad obchodních aktivit soukromých subjektů na lidská práva ABSTRAKT A KLÍČOVÁ SLOVA Abstrakt: Rigorózní práce se věnuje dopadu obchodních aktivit soukromých subjektů na lidská práva. Problematika je v kontextu OSN rozpracována konceptem "byznys a lidská práva". Práce se snaží postihnout stávající mezinárodněprávní rámec upravující otázky dopadu aktivit byznysu na lidská práva. Práce zkoumá přínos Obecných zásad OSN pro byznys a lidská práva, globálně přijímaného rámce pro předcházení a řešení negativního dopadu obchodních aktivit na lidská práva. Obecné zásady nejsou právně závazné, vycházejí však ze stávajících standardů ochrany lidských práv obsažených v mezinárodním i národním právu. Struktura Obecných zásad je založena na třech pilířích: povinnosti státu chránit lidská práva, odpovědnosti společností respektovat lidská práva a přístupu obětí k nápravě. Téměř sedm let po jejich přijetí existují četné příklady jejich implementace prostřednictvím národních akčních plánů či konkrétních legislativních opatření, aktivit mezinárodních a regionálních organizací. Práce popisuje několik národních akčních plánů a legislativních opatření přijatých státy a shledává, že k zajištění účinného předcházení porušování lidských práv ze strany byznysu by mělo být učiněno více. Práce se rovněž zabývá snahami o vypracování... Human Rights Impact of Business Activities of Private Entities ABSTRACT AND KEY WORDS Abstract: The thesis focuses on human rights impact of business activities of private entities. Within the UN context, it is the concept of "business and human rights" which addresses the issue. The thesis aims at depicting the current international legal framework relating to impact of business activities on human rights. The thesis examines the benefits of the UN Guiding Principles on Business and Human Rights, the authoritative framework and the global standard of practice for preventing and addressing the risk of adverse impact of business activities on human rights. While the Guiding Principles do not constitute a legally binding document, they build on existing standards and include elements covered in international and domestic law. The three-pillar framework consists of the State duty to protect human rights, the corporate responsibility to respect human rights, the access to remedy for victims of business-related abuse. Almost seven years after their adoption, there are numerous examples of how these Guiding Principles have been integrated into the Governments' national action plans, policies and regulations, policies of international and regional organisations.
