[cze][eng] Cílem této práce je poskytnout výklad k vybraným institutům nájmu bytu a to nejen pro plnění bytové potřeby nájemce, ale i pro ostatní využití. Práce je dělena do 4 na sebe navazujících kapitol, které postupně gradují k nejnovějšímu trendu flexibilních právních vztahů. V první kapitole se práce zabývá historickým úvodem, ve kterém byl shrnut vývoj institutu nájmu nemovitosti za úplatu od starověku až do devadesátých let minulého století s důrazem na instituty trvající, či znovu se objevující. Druhá kapitola zevrubně popisuje a vysvětluje jednotlivé klíčové pojmové znaky, mezi které patří předmět nájmu (jeho vlastnosti a vhodnost, která je nyní určena dohodou stran, nikoliv rozhodnutím úřadu ), stanovení úplaty za byt (když není stanovena smluvně) a stranám smlouvy. V této kapitole je dále shrnuto, proč si právnická osoba nemůže pronajmout byt k bydlení a proč jeho následný podnájem není podnájmem. V kapitole třetí se práce zaměřila na ustanovení, nejasná, nebo budící vášně jak mezi odborníky, tak mezi laiky. Mezi tato ustanovení patří nové pojetí jistoty, podstatné rozšíření možnosti podnikat v bytě i bez souhlasu pronajímatele, pojmu domácnosti a osob v ní a to včetně zamyšlení nad maximálním množstvím osob obývajících byt, pořádku a udržování dobrých mravů v domě a podnájmu. Práce záměrně...This thesis deals with selected institutes of legislation related to tenancy under recent Civil code No. 89/2012 Sb. With respect to a limited extend, the thesis focuses only on selected issues, such as definition of basic principles and concepts or unclear provisions. The thesis consists of 4 connected chapters, leading reader from past to present to gain historical and practical view on the matter First chapter is focused on legal history of lease of immovable since antiquity to nineties of last century. Second chapter covers basic principles and concepts of tenancy such as object of a lease (suitability of a rented space is now determined by agreement not by some official decision), parties of agreement, determination of rent (if it is not agreed in contract). This chapter also contains an explanation, why legal entity can not lease a flat for living and why a subsequent sublet is not a sublet but regular lease. Third chapter describes provisions considered unclear by professionals or laymen. These provisions contains new conception of surety, limits of making business or working in a flat without of consent of the landlord, receiving new members to the household (and of course definition of household) and sublet.
