Náhradní mateřství je považováno za jednu z nejvíce sporných a kontroverzních metod asistované reprodukce, kterou mají bezdětné páry k dispozici. Tento institut představuje pro společnost aktuální téma, neboť nabízí pomoc stále stoupajícímu procentu párů s poruchami reprodukce. Celospolečenská diskuze, která se v České republice o náhradním mateřství vede již od roku 2009 jak na odborné, tak i laické úrovni, přispěla k destigmatizaci stran, která náhradní mateřství uzavírají a máme tak přímá svědectví o tom, jak se s tímto institutem český právní řád ve své současné podobě vyrovnává. Tato práce poskytuje přehled o metodách asistované reprodukce, o jejich zákonné úpravě jak v právu mezinárodním, tak právu Evropské unie i právu vnitrostátním a o jejich historii. Práce dále pokrývá obecnou problematiku náhradního mateřství a snaží se určit hlavní rizika a problémy, které sebou užití náhradního mateřství přináší jak obecně, tak konkrétně v právním prostředí České republiky. Závěrem podává přehled politicko-právního vývoje, který se týká náhradního mateřství, na půdě Evropské unie a Rady Evropy. Práce se snaží zmapovat právní úpravu náhradního mateřství v České republice od prvního kontaktu stran náhradního mateřství přes platnosti a vymahatelnost jejich vzájemně sjednaných ujednání, až po porod dítěte a... Surrogate motherhood is considered one of the most disputed and controversial method of assisted reproduction available to childless couples. This contemporary topic assists rising numbers of couples with reproductive disorders. Professional and nonprofessional discourse on the topic of surrogacy has grown in the Czech Republic since 2009. This discussion has contributed to increasing destigmatisation of the parties that make use of the option of surrogate motherhood. As a result, we have first- hand accounts on how the Czech legal system in its current form responded. This diploma thesis presents an overview of the methods of assisted reproduction and their history as well as the legal basis for assisted reproduction in international, European and national law. Furthermore, the thesis touches upon the topic of surrogate motherhood with a view to identifying the risks and dangers of surrogate motherhood both in general and with a focus on the specific legal issues in the Czech Republic. In its conclusion it examines the politico-legal developments regarding surrogate motherhood both on the level of the European Union as well as the Council of Europe.
