[cze][eng] Resumé Tématem této diplomové práce je zásada superficies solo cedit, nebo "povrch ustupuje půdě". Jedná se o zásadu s původem v římském právu, která se dodnes promítá do právních řádů většiny evropských demokratických zemí. Je vyjádřením principu, dle kterého je součástí pozemku všechno, co je s ním pevně spojeno a co na pozemku vzešlo. Za součást pozemku jsou tak typicky považovány i stavby a rostlinstvo. Vlastník pozemku je tak zároveň vlastníkem jeho součástí, přičemž tyto sdílí jeho osud. Tato práce se zaměřuje na vývoj a úpravu zásady superficies solo cedit v římském právu, i v právních řádech platných na území České republiky až do současnosti. Těžištěm práce je analýza a komparace dosavadních právních úprav s aktuálně platným občanským právem, obsaženým v občanském zákoníku č. 89/2012 Sb. Pozornost je věnována i pojetí věcí v právním smyslu, pojetí nemovitých věcí a institutům souvisejícím, zejména právu stavby a jiným výjimkám ze superficiální zásady. V první kapitole nastíním původ zásady superficies solo cedit a její vyjádření v římském právu. Druhá kapitola je věnována právním úpravám platným na našem území a je rozčleněna do podkapitol zabývajících se rakouským Allgemeines bürgerliches Gesetzbuch z roku 1811, který byl do právního řádu Československé republiky převzat jako Obecný zákoník...PRINCIPLE OF SUPERFICIES SOLO CEDIT This thesis focuses on the superficies solo cedit principle, which can be translated as "the surface yields to the ground". The principle originated in Roman law and is projected into legal systems of most of the European democratic countries until today. According to this principle, everything firmly attached to the ground or grown on the land is component part of the land. Therefore, plants and structures are considered as typical component parts of the tract of land. The owner of the tract of land simultaneously and automatically owns its component parts. All dispositions regarding the tract of land must include the component parts, as component parts are not separate objects of law. This thesis deals with the evolution and regulation of the superficies solo cedit principle in Roman law, as well as in legal orders valid on the Czech territory until now. The main focus is on the analysis and comparison of previous legal regulations and currently valid civil law, represented by Act No. 89/2012 Sb., Civil Code. Close attention is given to the definition of things in legal sense, definition of immovable things and related legal concepts, particularly to the right of superficies and other exceptions from the principle superficies solo cedit.
