Shrnutí Tématem diplomové práce je institut rozhodčího řízení v České republice. Rozhodčí řízení je institut umožňující řešení majetkových sporů před nezávislým třetím. Výsledkem rozhodčího řízení pak je vydání závazného a vynutitelného rozhodčího nálezu. Rozhodčí řízení tak je řízením sui generis, které se odlišuje jak od obecného soudního řízení, tak i od ostatních způsobů ADR. V této práci jsem se především zaměřil na komplexní rozbor zákona č. 216/1994 Sb., o rozhodčím řízení a výkonu rozhodčích nálezů, a to ve spojitosti se studiem odborné literatury a judikatury. Diplomová práce je rozdělena na 9 kapitol, které jsou dále děleny do podkapitol. Diplomová práce je dále ohraničena úvodem a závěrem. První kapitola se zabývá definicí pojmu rozhodčího řízení a dále zde můžeme najít charakteristiku, výhody a nevýhody a vysvětlení teoretických koncepcí rozhodčího řízení. Druhá kapitola se zaměřuje na otázku arbitrability jednotlivých sporů. V třetí kapitole je podrobně rozebrána otázka rozhodčí smlouvy, a to včetně popsání náležitostí a rozdělení rozhodčích smluv podle jejich druhu. Čtvrtá kapitola se zabývá osobností rozhodce, požadavky na výkon funkce rozhodce, procesem jejich určení/jmenování a i případným vyloučením rozhodce z projednávání věci. Arbitration is an institute enabling resolution of property disputes before an independent third. The result of an arbitration is publication of binding and enforceable arbitration award. Arbitration is a type of sui generis proceeding, meaning it differs both from the general court proceedings, as well as from other ADR methods. In this work I was mainly focused on a comprehensive analysis of Act no. 216/1994 Coll., on arbitration proceedings and enforcement of arbitral awards, in conjunction with the study of literature and case law. The thesis is divided into 9 chapters, which are further divided into subchapters. The thesis is further bounded by introduction and conclusion. The first chapter deals with the definition of arbitration and furthermore here we can find the characteristics, advantages and disadvantages, and explanations of theoretical concepts of arbitration. The second chapter focuses on the question of arbitrability of individual disputes. The third chapter examines in detail the process of conclusion of the arbitration agreement, including a description of requirements and division of arbitration agreements according to their nature.
