[cze][eng] Tématem této magisterské práce je vztah mezi Soudním dvorem Evropské unie a členskými roveň práce vychází i ze zkoumání tzv. soudního aktivismu, konkrétně ve vztahu k Cílem práce je ověřit hypotézu, že hlavním aktérem, který ovlivňuje podobu unijního práva, je Soudní dvůr, a ne členské státy. K tomu práce uplatňuje dvě podhypotézy, a sice že: 1. Soudní dvůr při svém rozhodování v oblasti vnitřního trhu prosazuje prointegrační agendu, a to i navzdory preferencím členských států; 2. členské státy nejsou schopny právní stav z pro ně nežádoucí judikatury zvrátit ve svůj prospěch prostřednictvím přijetí nové je ověřena na příkladu judikatury Soudního dvora v občanů EU a poskytování přeshraniční zdravotní péče a v návaznosti na ni přijatých směrnic 2004/38/ES a 2011/24/EU. První podhypotéza je konkrétně ověřena analýzou stanovisek členských států v řízeních před Soudním dvorem a analýzou samotných rozsudků, a to ve čtyřech řízeních zabývajících se právy ekonomicky neaktivních osob a v šesti věnovaných poskytování přeshraniční zdravotní péče. Druhá podhypotéza je ověřena zkoumáním ustanovení dotčených směrnic, která navazovala na judikaturu Soudního dvora. Závěrem práce je, že první podhypotézu lze považovat s výhradou za vyvrácenou.
