[cze][eng] Tato práce pojednává o problematice zabezpe ování bezpe nosti státu, s d razem na institut tzv. mimo ádných stav v ústavním po ádku eské republiky. Úvodem jsou zkoumány základní zásady úpravy, historický vývoj, obecný bezpe nostní kontext i mezinárodní aspekty. Práce se podrobn v nuje jednotlivým mimo ádným stav m - stavu nebezpe í, nouzovému stavu, stavu ohrožení stavu a vále nému stavu. Každý z výše uvedených stav je podrobn popsán co do jeho specifik, zp sob vyhlašování i pravomocí jednotlivých orgán státu. Rozsáhlá kapitola je v nována i spole ným institut m. Poslední ást práce pojednává o dalších zp sobech zajiš ování bezpe nosti, a to v konotaci na l. 43 Ústavy R. Jde nap . o problematiku vysílání ozbrojených sil mimo území eské republiky a o pobytu ozbrojených sil cizích stát na území eské republiky i bližší úprava p ejezd a pr let p es území eské republiky. Ze záv ru práce pak vyplývá, že sou asná úprava mimo ádných stav není vhodn aplikovatelná v praxi a obsahuje adu nejasností. Vzhledem k povaze situací, za kterých k jejich aplikaci dochází, se toto jeví zna n nebezpe n a nabízí se úvaha o vhodnosti novelizace. Klí ová slova: mimo ádné stavy, zajiš ování bezpe nosti, nouzový stav, stav ohrožení státu, vále ný stavThis thesis discusses the issue of securing safety of the state with emphasis on the institute of so called states of crisis in the constitutional law of the Czech Republic. The first part deals with states of crisis in general, outlines the basic theory of states of crisis as institutes of law, historical and international context of regulation, as well as on a generally security oriented context. The second section is dedicated to individual states of crisis, namely the state of danger, state of emergency, state of threat to the state and state of war. The thesis contain the basic description of the state of emergency, its sources of law, the method of its declaration all of the states of crises and discusses institutes common for all, or most of the individual states of crisis. Last section of this thesis focuses on further methods of safety ensuring, in particular with connotation to Article 43 of the Constitution of the Czech Republic. For example the regulation of the dispatch of armed forces beyond the territory of the Czech Republic and the residence of foreign armed forces in the territory of the Czech Republic or the regulation of crossing and flying across the territory of the Czech Republic.
