Resumé Tato diplomová práce se zabývá ústavní a zákonnou úpravou náboženské svobody v České republice. Jejím cílem je popsat a zhodnotit současný stav právní úpravy a analyzovat její vybrané aspekty s přihlédnutím k judikatuře Ústavního soudu a Evropského soudu pro lidská práva. Práce je rozdělena do čtyř kapitol. První kapitola, jež poskytuje úvod do problematiky, se skládá ze tří částí. První část definuje základní pojmy, jež budou v práci dále používány. Druhá část rozebírá ústavní a zákonnou úpravu. Zmíněny jsou také relevantní mezinárodní smlouvy. Třetí část se pak soustředí na vztah mezi státem a náboženskými společnostmi a jeho vliv na úroveň náboženské svobody. Druhá kapitola se zaměřuje na vnitřní rozměr náboženské svobody (tzv. forum internum), jenž je vyjádřením neporušitelnosti vnitřního života člověka. Daná kapitola řeší rovněž právo na změnu náboženského vyznání a s ním související problematiku proselytismu. Třetí kapitola se zabývá vnějšími projevy náboženství nebo víry (tzv. forum externum). Popisuje jejich jednotlivé formy (konkrétně bohoslužbu, vyučování, náboženské úkony a zachovávání obřadu), jež jsou zakotveny nejen v Listině základních práv a svobod, ale také v řadě mezinárodních lidskoprávních smluv. Dále se věnuje možnostem omezení náboženské svobody a problematice náboženských... This thesis deals with the constitutional and statutory regulation of freedom of religion in the Czech Republic. The aim is to describe and evaluate the current state of legal regulation and analyse some of its aspects considering the judgements of the Constitutional Court and of the European Court of Human Rights. The thesis is composed of four chapters. The introductory chapter consists of three parts. The first part defines the basic terminology used in the following parts of the thesis. The second part examines constitutional and statutory regulation. Relevant international treaties are also mentioned. The third part focuses on the relationship between the state and religious communities, and its effect on the level of religious freedom. The second chapter concentrates on the inner dimension of freedom of thought, conscience and religion (the so-called forum internum) as an expression of inviolability of the inner life of a human. It also addresses the right to change religion or belief and problems which may result from proselytism. The third chapter deals with outer displays of religion or belief (the so-called forum externum).
