Nároky z porušení práva autorského a práv souvisejících s právem autorským v mezinárodním kontextu Cílem této práce je komplexně shrnovat aktuální mezinárodně právní stav nároků z porušení práva autorského a práv souvisejících. Z tohoto důvodu práce vymezuje předmět autorského práva a práv souvisejících, mezinárodní a evropskou právní úpravu, výkon a porušení těchto práv. Vzhledem k nehmotné povaze předmětů chráněných autorským právem a právy souvisejícími není dostatečné stanovovat opatření pouze na národní úrovni, právě naopak je nutné stanovit úpravu mezinárodně, protože k výkonu a porušování práv může dojít na mnoha místech současně. Tato práce se proto zabývá i aktuálními problémy digitální éry, které musí autorské právo a práva související řešit. Téma této práce je rozvrženo do pěti částí. První kapitola vymezuje práva duševního vlastnictví a zejména zvláštní povahu autorského práva a práv souvisejících. Druhá kapitola shrnuje většinu mezinárodních smluv z oblasti práva autorského a práv souvisejících a provádí vývojem mezinárodní úpravy. Dále kapitola jednak shrnuje evropskou úpravu autorského práva a práv souvisejících, a také obecně vymezuje požadavky na opatření k dodržování práv. Třetí kapitola shrnuje výkon autorského práva a práv souvisejících, se zaměřením na územní ochranu, výjimky a... Remedies for copyright and neighbouring rights infringement in international context The aim of this thesis is to comprehensively summarise the current international state of remedies for copyright and neighbouring rights infringement. For that purpose the thesis outlines subject matter of copyright and neighbouring rights, international and European legislation, execution and infringement of such rights. With regard to intangible nature of subjects protected by copyright and neighbouring rights, it is not sufficient to prescribe measures only at national level; on the contrary it is necessary to prescribe legislation internationally, because execution and infringement of rights can occur at multiple locations simultaneously. Therefore, this thesis also deals with current issues of digital era, which must be dealt with by the law of copyright and neighbouring rights. The topic of this thesis is divided into five parts. First chapter outlines the intellectual property rights and mainly the special nature of copyright and neighbouring rights. Second chapter summarises most of international treaties in the field of copyright and neighbouring rights and guides through the evolution of international legislation.
