Tato diplomová práce se snaží o zachycení některých aspektů vývoje trestního práva v 18. století v českých zemích. Zaměřuje se však téměř výlučně na trestní právo hmotné a o postihnutí jeho vývoje usiluje převážně srovnáváním vybraných právních institutů obsažených ve sledovaných trestních zákonících, které jsou řazeny chronologicky. Práce se skládá zúvodu, tří kapitol a závěru. Úvod práce představuje stručné uvedení do problematiky spolu s vymezením některých základních pojmů a zmiňuje i existující literaturu k tématu. První kapitola je rozdělena na tři části. První z těchto částí se věnuje stavu pramenů trestního práva na počátku 18. století a většímu prostoru se dostává kodifikaci městského práva a posléze i práva zemského. Následující část této kapitoly cílí zejména na trestní zákoníky Josefa I. a Marie Terezie, které byly publikovány v 18. století. Poslední část této kapitoly se pak zabývá dvěma dalšími publikovanými trestními zákoníky a to Josefa II. a Františka II., které už vycházejí z osvícenské filozofie, z nichž posledně zmíněný již spadá do 19. století. Druhá kapitola podává přehled vybraných institutů trestního práva hmotného. Opět je dělena na tři části, přičemž první část se zabývá trestným činem a souvisejícími instituty jako pokusem trestného činu, nutnou obranou apod. Druhá část... Progres of Criminal Law in 18th Century in Our Countries Abstract This thesis attempts to show certain aspects of the progress of the criminal law in the 18th century in the Czech Crown Lands. It mainly focuses on substantive criminal law and captures its evolution by comparison of selected instruments of law contained in analyzed criminal codes, which are sorted in chronological order. The thesis is composed of an introductory, three chapters and a conclusions. The introduction briefly defines topic and basic terminology used in this thesis and also mentions existing literature. The chapter one is subdivided into three parts. The first part deals with the state of the sources of criminal law at the begining of 18th century and than mainly focuses on the codification of the municipal law and also on The Renewed Constitution. Next part of the chapter is aimed at the criminal code of Joseph I and at the criminal code of Maria Theresa, which were published in the 18th century. The last part concentrates on two more criminal codes, namely criminal code of Joseph II and also criminal code of Francis II, both being influenced by the philosophy of the age of enlightenment, while the later being published in the 19th century.
