V každé společnosti napříč dějinami existuje určitá skupina dětí, které se ocitnou bez péče a ochrany vlastních rodičů. V takovém případě je nutné, aby jim ze strany státu byla tato péče a ochrana zajištěna prostřednictvím právních institutů nahrazujících rodinné zázemí. Cílem této rigorózní práce je přehledně tyto instituty zmapovat, a to jak z pohledu hmotněprávního, tak procesního. Obecně lze náhradní péči o nechtěné děti rozdělit na tzv. náhradní rodinnou péči a ústavní péči. Jak už vyplývá ze samotného názvu, náhradní rodinná péče se díky svému uzpůsobení a uspořádání snaží dětem, kterým je potřeba zabezpečit fyzickou i právní ochranu, poskytnout zázemí připomínající skutečnou rodinu. Patří sem institut osvojení, poručenství, opatrovnictví, svěření do výchovy jiné fyzické osoby a různé formy pěstounské péče. Ústavní péče je poskytována zásadně v ústavních zařízeních, je vykonávána kolektivně, a proto zásadně nenahrazuje rodinou péči poskytovanou individuálně. Právě z těchto důvodů by měly mít instituty rodinné péče vždy přednost před ústavní výchovou, ke které by tak mělo být přistupováno pouze v případech, že se dítě nepodaří umístit do náhradní rodiny. Po dlouhé době úprav a změn proběhla rozsáhlá rekodifikace soukromého práva, která mimo jiné zrušila do té doby platný zákon č. 94/1963 Sb.,... In every society throughout the history there is a group of children that find themselves without care and protection of their own parents. In such a case it is necessary that the care and protection is secured by legal institutes that substitute the family.The aim of this thesis is to describe these institutes both from substantive and procedural point of view.The alternative care for unwanted children can be divided to foster care and institutionalized care. Foster care is trying to provide these children with both physical and legal protection and with a background that resembles a real family.Institutes such as adoption, wardship, tutelage, and other belong under foster care. Institutionalized care is provided in institutional facilities. It is performed colectively, and therefore could not substitute individual family care.Due to these reasons the foster care institutes should always precede before institutionalized care that should be used only in cases, in which the child cannot be placed into foster family.After a long time of modifications and changes an extensive recodification of private law took place that canceled until that time applicable family law number 94/1963 Coll. that was originally a main source governing institutes of foster care and institutionalized care.Currently the...
