v českém jazyce Diplomová práce se věnuje úpravě způsobu a rozsahu újmy v občanském právu, která je systematicky zařazena do části čtvrté nového občanského zákoníku, nazvané Relativní majetková práva a dále do její hlavy třetí, označené jako Závazky z deliktů. Konkrétně způsobu a rozsahu škody jsou věnována ustanovení § 2951 až § 2971. Práce obsahuje základní srovnání úpravy způsobu a rozsahu újmy ve starém a novém občanské zákoníku s důrazem na nejpodstatnější změny. Přibližuje novou terminologii a nově zavedené instituty. Obsahuje analýzu nejen české právní úpravy, nýbrž zmiňuje i evropskou tendenci úpravy způsobu a rozsahu náhrady a okrajově porovnává českou podobu některých institutů s úpravou v okolních zemích. Práce je uspořádána v návaznosti na systematiku ustanovení o způsobu a rozsahu náhrady v novém občanského zákoníku a stejně jako ona se člení do tří částí. První z nich se věnuje náhradě škody. Jejím hlavním tématem je způsob a rozsah náhrady škody a předpoklady jejího snížení. Obsahuje také úpravu náhrady škody způsobené úmyslným trestným činem a pravidla určování výše náhrady škody soudem v případě, kdy ji nelze přesně vyčíslit. Tématem druhé kapitoly je nemajetková újma s důrazem na újmu na zdraví. Kapitola obsahuje definice bolestného, ztížení společenského uplatnění a dalších... in English This diploma thesis deals with the manner and extent of compensation for damage in civil law, which is systematically included in the fourth part of the Civil Code, entitled Relative property rights and in section named Obligations arising from torts. Specifically, the manner and extent of compensation for damage is defined in articles from 2951 to 2971. The thesis contains basic comparison of the conceptions of the manner and extent of compensation in the former Civil Code and in the new one, with emphasis on the most important reforms. It clarifies new terminology and describes the background of the newly established rules of law. It contains an analysis of the Czech legislation and its comparison with legislation of the neighboring states. It also mentions the European conception of the manner and extent of compensation for damage. The system of the thesis follows the organisation of the provisions on the manner and extent of compensation in the new Civil Code and is also divided into three chapters. The first one deals with compensation for material damage. Its main issue is the manner and extent of the material compensation and the conditions for its reduction.
