Tato práce se zabývá právní úpravou nájemní smlouvy s tím, že se podrobněji zaměřuje na nájem bytu. Nájemní smlouva je hodnocena z pohledu právní úpravy, odborných článků a judikatury, která hraje velmi důležitou roli při výkladu některých zákonných ustanoveních upravujících nájemní smlouvu. Práce je zpracována, jak z pohledu zákona č. 40/1964 Sb., občanský zákoník, tak z pohledu nové právní úpravy zákona č. 89/2012 Sb., občanský zákoník. V této části práce jsem se zabývala rozdíly mezi předchozí a současnou právní úpravou a zhodnotila pozitiva a negativa, která nová právní úprava z mého pohledu přináší. This dissertation is concerned with the legal regulation of the lease contract and it is concentrated in detail on the lease of the flat. The lease contract is evaluated from point of view of the legal regulation, the expert articles and judicatures, which act very important function at the interpretation of some provisions regulating the lease contract. The dissertation is made from point of view of the code No. 40/1964 Coll., Civil Code and from point of view of the code No. 89/2012 Coll., Civil Code. In this part of the dissertation I was concerned with the differences between previous and present legal regulations and I was evaluated positives and negatives, which the new legal regulation brings from my point of view.
