[cze][eng] Cílem práce je uchopit právo z pohledu některých psychických a sociálních fenoménů, resp. faktorů, vyjadřujících naše sebeprožívání. Při změně psychického faktoru lze přepokládat adekvátní změnu práva či náhledu na fenomén práva, což můžeme považovat za důkaz, že fenomény práva jsou navázány na psychické a sociální fenomény. Otázka sebeprožívání je konkretizována na otázku, zda má na právo vliv, pokud se prožíváme individualisticky či kolektivisticky. Diplomová práce pracuje s myšlenkovými modely, které pojímá jako ideální typy, jež uchopuje filosoficky, nikoli historicky. Jako model individualistického prožívání je zvolen model mysli Reného Descarta. Jako model kolektivního sebeprožívání či sebepojetí je zvolen model subjektu Carla Gustava Junga, doplněna v dílčích bodech úvahami Émila Durkheima, Emanuela Lévinase, Edmunda Husserla a Eliase Canettiho. Práce předpokládá, že se do práva psychické fenomény a jejich změna promítnou v právních normách jak z hlediska jejich tvorby, tak z hlediska vymáhání jejich dodržování a z hlediska jejich interpretace. Zvláštní pozornost je věnována otázce, kdo, případně co je to suverén a z hlediska prezentovaných typů sebepojetí subjektu se zamýšlí i nad způsobem uzavření tzv. společenské smlouvy, již je možno považovat za faktickou ústavu a počátek práva. Z...The aim of this thesis is to approach law from the perspective of some psychological and social phenomena and factors expressing our selfexperience. When the psychological factor is changed, an adequate change of the law or its interpretation can be assumed. This can be considered as the evidence that the phenomena of law are linked to psychological and social phenomena. The question of selfexperience is instantiated to the question whether law is affected by our individualistic or collectivist selfexperience. This thesis operates with mental models that are conceived as ideal types, which are approached philosophically rather than historically. René Descartes' model of mind was chosen as a model of individualistic experience. As a model of selfexperience or collective selfimage, Carl Gustav Jung's model of a subject was selected and supplemented with considerations of Émile Durkheim, Emmanuel Lévinas, Edmund Husserl and Elias Canetti. The thesis assumes that psychic phenomena and their changes will be reflected in legal norms both in terms of their formation and in terms of enforcing their observance and in terms of their interpretation.
