Cílem mé rigorózní práce je analyzovat územní samosprávu v Japonsku a v České republice ze srovnávací perspektivy a podat přehled hlavních rozdílů a podobností mezi právním pojetím místní a regionální samosprávy v obou zemích. Práce se skládá z deseti kapitol, z nichž každá se zabývá typickými rysy japonské samosprávy, jako jsou její ústavní základy, osobní a územní rozsah japonských prefektur a obcí etc. Zatímco liché kapitoly jsou spíše analytické povahy, sudé kapitoly se soustředí na detailnější srovnání výše nastíněných právních problémů s jejich příslušnými protějšky v českém právu. První dvě kapitoly se zabývají otázkou ústavního zakotvení územní samosprávy v obou zemích, přičemž jsou zřetelné velké podobnosti v obou právních řádech, kdy hlavním rozdílem je toliko výslovné ustanovení týkající se přímé volby starostů a guvernérů v japonské úpravě. Následně autor podává přehled a podrobnou analýzu tzv. základních znaků samosprávných celků, kterými jsou konkrétně obyvatelstvo, území a právní subjektivita včetně práva na samosprávu. Třebaže jejich elementární rysy se mohou v obou zemích překrývat, rozdíly vyvstávají v okruhu osob majících status obecního (nebo krajského či prefekturálního) občana, v jejich právech z tohoto postavení plynoucích, stejně jako v procesní stránce možných územních změn... The purpose of my research is to analyse the territorial self-government in Japan and the Czech Republic from a comparative perspective and provide an outline of the main differences and similarities between the legal conception of local and regional self- government in these two countries. The thesis is composed of ten chapters, each of them dealing with some typical features of the Japanese self-government, such as the constitutional foundations, the personal and territorial dimension of Japanese prefectures and municipalities etc. While the odd chapters are mainly analytical, the even chapters focus on a more detailed comparison of the aforementioned legal issues with their respective equivalents in the Czech law. The first two chapters deal with the question of the constitutional foundations of the territorial self-government in both countries, finding great similarities in both legal conceptions, the main difference being the express provision for direct election of mayors and governors in the Japanese one. Subsequently, the author gives an overview and detailed analysis of the so called basic elements of the self-government, namely population, territory and legal personality including the right to self-government.
