Nenáležitá transpozice směrnice EU je jev, ke kterému dochází vcelku v nezanedbatelném množství a v rámci plnění povinnost tudíž pro jednotlivé členské státy představuje poměrně běžný, ač nežádoucí fenomén. Předkládaná diplomová práce se pak tématem zabývá v rámci České republiky ve světle jednotlivých řízení, která byla proti České republice vedena. Práce je rozdělena do celkem šesti kapitol, přičemž vychází z teoretických základů, které následně aplikuje v praktických příkladech. První kapitola představuje teoretické těžiště pro zakotvení pojmu primární a sekundární právo s důrazem na směrnice EU, kdy je tento unijní právní předpis analyzován jak z obecného hlediska, tak i z hlediska své struktury. Navazující druhá kapitola následně podává výklad k problematice náležité a také nenáležité transpozice směrnice a uvádí jednotlivé následky, které se s nenáležitou transpozicí směrnice EU spojují. Praktická část začíná od třetí kapitoly, která obsahuje analytickou sumarizaci veškerých řízení, která byla proti České republice dosud vedena z důvodu nenáležité transpozice směrnice EU a zároveň skončila rozsudkem, zatímco čtvrtá kapitola obsahuje ta řízení, která byla zastavena a skončila usnesením. Obsahem předposlední kapitoly je především sumarizace předešlých řízení a rešerše příslušných dokumentů EU a Senátu... Improper transposition of an EU Directive is a phenomenon that occurs in quite an appreciable amount and in the performance of duty of individual Member States this represents a relatively common, although undesirable situation. The submitted diploma thesis deals with this issue within the Czech Republic in the light of individual proceedings for the failure to fulfill an obligation resulting from EU Treaties, which were concucted against the Czech Republic. This thesis is divided into six chapters, based on the theoretical foundations that are subsequently applied in practical examples. The first chapter presents the theoretical center of gravity for embedding the concept of primary and secondary law with emphasis on the EU Directive, while the this EU legislation is analyzed both in general terms and in terms of its structure. The following second chapter then gives an explanation to the issue of proper and improper transposition of an EU Directive and individual consequences that are associated with improper transposition of an EU Directive. The practical part starts from the third chapter, which contains analytical summarization of the all proceedings against the Czech Republic, which were conducted because of improper transposition of an EU Directive and ended with a judgement, while the fourth chapter...
