Dne 1. 1. 2010 nabyl účinnosti nový právní předpis trestního práva hmotného, zákon č. 40/2009 Sb., trestní zákoník (dále jen "nTZ" - nový trestní zákoník). Tím došlo v oblasti trestního práva hmotného k významné derogaci. Cíl: Předložená bakalářská práce se skládá ze dvou základních částí, které jsou vzájemně provázány a navazují na sebe. Hlavním cílem v teoretické části je deskripce jednotlivých změn, ke kterým došlo ve skutkových podstatách drogových trestných činů (dále jen "DTČ") u zákona č. 140/1961 Sb., trestní zákon (dále jen "sTZ") a nTZ. Hlavním cílem v praktické části této práce je porovnat statisticky evidovanou trestnou činnost páchanou v souvislosti s omamnými a psychotropními látkami (dále jen "OPL") a jedy v letech 2007 - 2009 a v letech 2010 - 2013 (komparativní studie). Tedy porovnat stav primární drogové kriminality, která je však ze své podstaty latentní, v době 3 roky před a 3 roky po změně hmotně právní normy. Primární drogovou kriminalitou se rozumí tzv. drogové trestné činy podle § 283 - § 287 nTZ, podle sTZ byly označeny § 187, 187a, 188, 188a). Tyto trestné činy jsem porovnával z hlediska počtu trestně stíhaných, obžalovaných a odsouzených osob, a dále jsem se rovněž zabýval porovnáním trestů, které byly za tyto trestné činy uloženy. Hlavním cílem práce je zhodnotit, zda se... New standard relating to questions of law ( nb. 40/2009 collection) or new penal code started its efficiency on 1st January 2010. It meant meaningful derogation of old penal code. Goal: My Bachelor's work consists of two main parts which are interconnected and they follow each other. Itn the theoretical part it is the description of individual changes which happened in the facts of the case of drug crimes ( the law nb. 140/1961) The main goal in practical part ( the comparative study) is to compare according to statistics the crimes commited in connection to using drugs and poison between 2007 - 2009. It means to compare the situation of primary drug criminality 3 years before and 3 years after the change of judicial code. By the primary drug criminality is understood so called drug criminal offence according to law 283 - 287 ( new penal code). I compared these offences according to number of condemned, accused and criminally chased persons and I also dealt with the comparison of punishments given for these crimes. The main goal of my work is to evaluate if acceptance of new penal code somehow showed the increasing number of person who are in the process of criminal case and the increasing number of punishments.
