Téma "Neplatnost právních úkonů v českém právu ve srovnání s právním řádem Německa" autorka zvolila, protože to je stěžejní problematika občanského práva, která se dotýká všeho a všech. Zároveň je toto téma vysoce aktuální vzhledem k právě proběhlé rekodifikaci občanského práva, jež v tomto směru přináší zcela zásadní změny. Srovnání s německou úpravou autorka pokládá za přínosné jednak pro její ustálenost, která kontrastuje s českou úpravou, jejíž kontinuita byla během posledních sta let několikrát zcela přetržena, a jednak kvůli absenci vlivu komunistické ideologie, jež měla tak velký dopad na českou úpravu. Práce je rozdělená do šesti kapitol a každá z nich obsahuje tři části - jedna pojednává o dosavadní úpravě podle zákona č. 40/1964 Sb., druhá o nové úpravě podle zákona 89/2012 Sb. a třetí o německé úpravě dle BGB. První dvě kapitoly mají za úkol poskytnout přehled především o teoretických východiskách této problematiky. První se zabývá přímo právními úkony, coby nejdůležitějšími právními skutečnostmi, a jejich pojetím. Jsou zde popsány jejich náležitosti, dále terminologické a koncepční změny dle NOZ a pojetí dle německého práva. Druhá kapitola pojednává o samotné neplatnosti, respektive jejích druzích dle každé z úprav, tedy relativní a absolutní, také o zdánlivosti a dále o obdobných... The topic "Invalidity of Legal Acts in the Czech Law in Comparison with the Law of Germany" has been chosen because of its importance in the system of the Czech Civil Law. Invalidity of legal acts concerns every subject and object of legal relationships. Nowadays this topic is also very actual due to the recodification of Civil Law which brings fundamental changes. Comparison with German legislation is very contributive thanks to its consistency during 20th century that is in contrast with inconsistency of Czech legislation caused by political changes (especially by 40 years of communism in the territory of the Czech Republic). The thesis is divided into six chapters and each chapter contains three parts. The first part deals with the old regulation under the Act No. 40/1964 Coll., the second one the new regulation under the Act. No. 89/2012 Coll. and finally the third one discusses the German regulation under the German Civil Code. The first two chapters are designed to provide an overview of mainly theoretical resources. The first chapter concerns with legal acts as the most important legal facts and their concepts.
