Tato studie se prioritně zabývá trestním právem doby evropského osvícenství a zaměřuje se zejména na české země. Autor popisuje změny v koncepci a pojetí trestního práva. Zdůrazňuje nové zásady ve vědě trestního práva a v trestněprávních kodifikacích. Mezi těmito zásadami se věnuje zejména rovnosti a také sekularizaci trestního práva. Autor se zajímá více o osobnost Josefa von Sonnenfelse, který ovlivnil trestní právo v době panování Josefa II. Klíčovým problémem této doby je i diskuse o možném zákazu trestu smrti. Autor se zabývá i organizací a kompetencí policie , ve které viděl Sonnenfels důležitý moment v ochraně společenského řádu. This work is primarily devoted to the penal law in the Age of Reason in Europe and in the Czech lands especially. The author describes changes in the conception of the penal law. He stresses the new principles in the science of penal law and in penal codifications. Among these principles draws attention mainly to the equality and secularization of the penal law as well.
