Cílem této práce je ukázat vlivy evropského a anglo-amerického práva, často souhrnně označovaného jako "západní právo", na japonský ústavní systém. Děl v českém jazyce, zabývajících se tímto tématem, je velký nedostatek, proto se tato práce snaží zaplnit tuto mezeru alespoň zčásti tím, že poslouží jako průvodce tématem recepce západního práva do japonského ústavního systému a poskytne základní přehled o tomto tématu. Tato práce kombinuje právně historické a ústavněprávní témata a doplňuje je informacemi o aktuální situaci. Práce je rozdělena na dvě kapitoly. První kapitola se zabývá Ústavou Japonského císařství, známou též jako Meidži ústava. Druhá kapitola se zabývá Ústavou Japonska, poválečnou ústavou z roku 1946. První části obou kapitol se zabývají historickou a politickou situací, objasňují důvody, které si vynutily přijetí nových ústavních dokumentů - v případě Meidži pád šogunátu a vliv nerovných smluv, v případě poválečné ústavy z roku 1946 prohra Japonska ve druhé světové válce a tlak vítězných mocností. Druhá část u každé kapitoly se věnuje obsahu jednotlivých ústav, srovnává je se západním právem a poukazuje na místa jím ovlivněná. Rovněž poukazuje na rozdíly mezi původní inspirací, výsledným textem a aplikační praxí. Občas vytýká významné případy velkých rozdílů mezi stavem de iure a de... The purpose of this thesis is to show the influences of the European and Anglo-American law, also called "western law", on the Japanese constitutional system. Even though the theme is rich and interesting, there is a lack of written works in Czech language on this topic, so I decided to produce a work that could offer an overview and serve as a guide to this subject. The thesis combines topics of constitutional law and legal history, while taking note of current circumstances as well. The thesis is divided into two chapters. First chapter examines The Constitution of the Empire of Japan, also known as Meiji constitution, the second chapter explores The Constitution of Japan, the postwar constitution from 1946. These chapters are further divided into smaller parts. First parts of both chapters deal with historical circumstances in Japan that resulted in the adoption of the constitutions, and the dramatic changes in political situation that called for new constitutional documents - be it the fall of the shogunate and unequal treaties in the case of Meiji constitution or Japan losing in the Second World War in the case of the postwar constitution from 1946.
