SHRNUTÍ Cílem diplomové práce je ověření hypotézy, že současná právní úprava volebního zákona odpovídá ústavním principům. Současně je záměrem práce označit části zákona, které by mohly být v rozporu s Ústavou. Ověření, popř. odmítnutí, hypotéz je dedukováno z odpovědí na výzkumné otázky, tj. zda je volební systém při volbách do Poslanecké sněmovny Parlamentu České republiky a je-li nyní příhodné současný volební systém měnit, případně jakým způsobem (za použití jakých prostředků). K nalezení odpovědí na výše zmíněné výzkumné otázky je použita metoda analýzy primárních a sekundárních informačních zdrojů, jejich interpretace a dedukce odpovídajících závěrů. Práce je členěna do dvanácti kapitol (včetně úvodu a závěru, resumé a použité literatury), přičemž za jádro práce lze nepochybně považovat pátou až osmou kapitolu. Druhá kapitola se zabývá teoretickým rozborem jednotlivých volebních systémů. Následující kapitola pak přináší pojednání o vývoji volebního systému při českých a československých parlamentních volbách v průběhu dvacátého století. Čtvrtý oddíl diplomové práce se pak zabývá ústavním zakotvením volebního systému při českých parlamentních volbách a základními principy volebního práva. V závěrečné kapitole jsou pak shrnuty získané poznatky a současně potvrzeny, popř. vyvráceny hypotézy nastíněné v... The goal of this diploma thesis is to verify hypotheses that the current legal framework of election law is in accordance with constitutional principles. Furthermore, author's intention is to highlight parts of the statute which may violate the Constitution. Such verification or rejection of hypotheses is deduced from the answers on the research questions, for instance if the voting system used within the course of the election to the Czech House of Representatives and if is desirable to modify the voting system and, if relevant in what manner (by what means). In order to answer these questions, the author applied the method of analyzing primary and secondary information sources, their interpretation and deduction of relevant conclusions. This thesis is divided into twelve chapters (incl. preface and conclusion, resume and bibliography) provided that the merit of the work can be found from chapter five to chapter eight. The second chapter is devoted to theoretical elaboration of individual voting systems. The following chapter discusses the evolution of the voting system used within the course of Czech and Czech-Slovak parliamentary elections in the 20th century.
